How about the incompetence of the GPD for serving the warrant at the wrong freaking house! The judge relied on the information of the PDs investigation to authorize the warrant. The judge is supposed to know that the PD is too incompetent to know where the suspect lives?

Allegedly, the person they were looking for left the house SWAT raided two hours before.

Still an absolute ****show.

This one is interesting. The story said the suspect was at the raided house, but had left 2 hours before?

Did the suspect stay/crash there? Was he a family member? Was he dating the daughter?

I agree "no knocks" need to go away, but there's more here.

Correct. The suspect also turned himself in and the charges were dropped entirely. So how stupid is this PD that they SWAT the wrong house AND their suspect had an alibi that resulted in all charges dropped?

The way I see it, they knew the suspect was there (they got a warrant for that house) and then stopped observing it?

I don't know what police protocol normally is, but I imagine you'd like to know where your murder suspect is before you go breaking down doors to find them.

So did the cops think this kid, that was then cleared of wrong doing, lived at that home?

So go after the wrong kid... Then no knock/destroy his friends house. Way too go blue! Way to go

Hate for his career to come down to a bad call from underlings, but when you lead, you lead alone.
10 day suspension + investigation should garner if he did the wrong thing.

The kid was friends with the son of the home owner… he left the house on foot at midnight and they raided the home at 2:00am. They shot 15 flash bangs in to the home, tore the place up during the search, and then they realized that the kid was falsely accused. Our chief hasn't been chief for long, so I assume he'll get to keep his job as a long time member of the force with an otherwise good record. I serve on the school safety committee with him in Galveston and he's the most involved police chief we've ever had. His main issue here is the lapse in communication he had with his officers before the raid and his lack of communication with city officials after the raid. It'll be interesting to see how this one shakes out!

I would need more information to pass judgement on this. Was the guy they were looking for a valid suspect, or was it a clerical error and they got the wrong name? Maybe he was a valid suspect, but he was able to provide a solid alibi after he was arrested. And he WAS present at one point at the house they raided. It's not like they raided some completely random unrelated house.

They go into what they believe is the HOME of a 17 YEAR-OLD like it's Fallujah?? WTF? There is a segment of law enforcement that has become Call of Duty and it needs to be reigned in.

No knock warrants are an aphrodisiac for the cops with huge beer guts who haven't seen their dick in a decade. They should be illegal. Those at fault in this one should have to pay for repairs out of their own money.

I am in no way defending what happened, I know zero facts about the case. But was does the suspect being 17 have to do with it? If he had turned out to be the right guy he we have adult charges and would have shown himself to be just as dangerous as a 35 year old. A teenager shooting you makes you just as dead as a 35 year old shooting you. (Except apparently this one who didn't shoot anyone).

Why couldn't they just wait for the kid to leave the house and arrest him then?

Seems like increased danger for all parties to go busting into a house guns drawn in the middle of the night

I think living at home with mommy and daddy and brother and sissy warrants different tactics than going into his own crib or one in which he is living with his gang bangers. Either way, this is excessive force.

Shockingly many gangbangers aren't big on have a good credit score and paying bills, leading them to live with mom and dad. This is one reason family members are often collateral damage in gang violence. So again, what part about him being 17 makes him less dangerous than a 35 year old?

Two Aggies are representing the Rios family

Tony Buzbee and Mark Metzger

Quote:

Police knew a 17-year-old murder suspect had left a house on Avenue O before a SWAT team launched a destructive raid there Jan. 22, Tony Buzbee, an attorney representing two families involved in the incident, asserts.

Buzbee, along with Galveston attorney Mark Metzger, is representing the families of Erika Rios, whose house was raided, and Cameron Vargas, 17, who was briefly charged with murder based on the false statement of what police had thought was an eyewitness to the Jan. 20 shooting death of Malik Dunn.
Mark is a friend and an Aggie Football Letterman

I liken this to Still Hunting vs Stalk Hunting. Sitting still for hours at a time is boring, slow, doubt-inviting, and feels passive. It feels so much more better to go walking through the deer's home and scare him up. But it's very often the less successful choice.

And the decision to authorize a no-knock raid, especially in this circumstance. If it's not even the kid's home, it's absolutely certain that completely innocent people were there. What if the mom were awakened by all the banging at 2:00 AM and grabbed her gun? She would be dead. Why couldn't they have picked up the kid on the way to school, or at his own home? I back the blue is almost all cases, but when I see stupidity like this I call them out.

Yes. That's why you have surveillance on the suspect up until the moment of the raid.

Uhhh... they usually go in heavy when it is a homicide suspect. Even though this time it turned out to be false.

It has nothing to do with his age and more the circumstance that he is living at home. More about them than him. It is ridiculously heavy handed, destructive, and dangerous for his family. There are other ways and better ways.

We are going to have more and more instances of incompetence as more good and dedicated LEO's call it quits because they no longer feel its worth the risk for them or their families. Couple that with relatively low pay compared to the risk involved and the situation will get worse as standards and qualifications are lowered to get anyone to take the job.
