They are going to take it up now because of the recent case on bumpstocks out of the 5th Circuit. The dicta in that case also addresses this type of administrative rule making by the ATF and brother it is not favorable to the ATF.

There is already a case with the fifth on this, 2AF was ahead of the game on this one.

Between the fifth circuit bump stock case and West Virginia vs EPA, the pro-2A side is as prepared and ready legally as can be for this one.

Case in point: On this board about 8 months ago, I offered up a hypothetical to a typical communistic poster.

A system is put in place that virtually guarantees the 'soundness of mind' of gun owners; that does not have loopholes; and requires all gun owners to submit to.

This in return for all previous gun laws to be repealed. All of them. Every single one. And explicitly guaranteed right of universal concealed carry in every single state and locality. Thus greenlighting ownership of full auto.

The "pistol" this stupid ass new rule applies to are AR pistols, which actually do fire the same .223/5.56 round that an AR rifle does. Braces do make it easier to shoulder, which is desired because it makes the gun/shoter combo more accurate, and that is a good thing.

Absolutely drives me insane that an agency of unelected bureacrats can make law. We have zero real recourse outside of going to the courts, which is not a permanent fix in most cases. Congress needs to put a massive chole hold on the ATF and incan only hope the cpurts again put the feds in their fuggin place when this gets to the SC.
