Understood, and apologies if my question seemed like a dig at you for posting this. My cynicism is toward the intent of the article/reporter. This does not, at all, highlight this law as some sort of "injustice to women's rights" but as a perfectly sensible charge to pin on this POS.

Read the story, they were separated but working on the marriage.

Quote:

Anthony Osso, the assistant district attorney in the domestic violence division assigned to this case, said the couple separated earlier in 2022 but were working on their marriage. In February, Herring learned his wife was pregnant with their baby.

"My understanding is that it wasn't well-received by (Herring)," Osso said. "That came out through marriage counseling, as well as through text messages later on."

Was wondering why someone would kill their own child, but then remembered he is probably a Democrat and that is just something they like to do and call it 'healthcare for women'....
Chances that it wasn't his?

How old was the baby in the wombs (# weeks)? I hope this somehow gets turned into a Supreme Court case to say babies in the womb have rights.

Sounds like she had the cameras installed after suspecting he was putting something in her drinks. She only drank it once. I'm guessing she was advised to get some proof.

If he'd just killed his estranged wife outright, he would be charged with 2 counts of murder.

Instead by targeting just the baby, we play legal gymnastics.

I tried a case against him. He also used to live in my neighborhood and his kids went to same school as my kids (ROBS). My wife also knows his wife well. Crazy ass story. I feel bad for his wife and kids.

My understanding is that she put in camera after she suspected he might have been drugging her. Once she had the suspicion, she would not drink anything he gave her but she needed evidence.

That about sums it up.

Quote:

Following the news, the woman said Herring lectured her on staying hydrated while pregnant.

"On the morning of March 17, the defendant, Mr. Herring, goes by the house to bring breakfast and asks if he can bring her water in bed," Osso said. "Again, (he) is talking to her about needing to stay hydrated. He says, 'If you don't do so, I'm not leaving.' She thought it was odd. She thought the water was cloudy. She questioned him a little bit, but, nonetheless, did drink the water, and then he leaves and takes that cup."
The woman became violently ill shortly after and ended up in the hospital. Doctors could not pinpoint what was wrong, according to Osso.

From then on, the woman was suspicious based on Herring's reaction to the news of her pregnancy. She did not drink the water Herring was giving her, but kept it as evidence.

She set up cameras at their home, where he was no longer living.

"(On April 24), she checks the garbage cans and finds in the garbage can a pharmaceutical called Cyrux, which contains Misoprostol, which is a drug used to induce abortions," Osso said.

Two days later, cameras inside their kitchen caught Herring putting a powdered substance into a glass and making a drink, according to Osso. The woman said her husband brought her the drink after.

A Houston attorney is the first and only person in Harris County to face a charge of forcing induction to have an abortion.

Mason Herring is the founder and managing partner of the Herring Law Firm, which focuses on energy and natural resources.

He was arrested on a warrant at the airport after returning from Las Vegas.

He's not charged with violating the new abortion law, he's charged with violating the assault statute, since it has increased penalties for assaulting someone while knowing they're pregnant and assaulting someone that's pregnant with the intent to force them to have an abortion. He's facing up to ten years.

I can't stand to be away from my children (even though they're *******s most of the time) for more than a few hours. I just don't understand the evil it takes to kill a child, MUCH less your own.

No kidding. Knowing the struggles (and devastating heartaches) that we went through to even have kids, this is double for me. My oldest is on a school trip and I started missing him when I dropped him off at the bus.

Sec. 22.01. ASSAULT. (a) A person commits an offense if the person:

(1) intentionally, knowingly, or recklessly causes bodily injury to another, including the person's spouse;

(b) An offense under Subsection (a)(1) is a Class A misdemeanor, except that the offense is a felony of the third degree if the offense is committed against:

(7) a pregnant individual to force the individual to have an abortion; or

(8) a person the actor knows is pregnant at the time of the offense.

The law he's charged with violating has existed since 2019, so he wasn't charged under the new abortion law.
