I believe under the WARN Act, you can walk people right away, so long as they get a 60 day notice (and accompanying pay checks & bennies). Not sure what they would be sueing about.

No idea since I don't work for Twitter, but I would expect the majority of the cuts are via layoff. The executive team were fired for cause (different mechanic). And yes though IANAL either, employment law handles firings and layoffs differently.
