What Frum is saying is stupid because he's a broken man.

That said...in Elon's case, given all the govt kickbacks he's received to build his empire there's a slight piece of legitimacy to that Obama statement.

However, I'll never blame someone for taking advantage of poor government policies. It's the gov't who is to blame.

Just because there's precedent doesn't make something legal. There's precedent for slavery in this country. But the 13th amendment (not to mention the original constitution and various state and federal laws) outlaws that for good. But the precedent part of it has no value.

Precedent as a standard is way overused. Its one thing if its used when the decision could go either way, but to go to it immediately has never made any sense to me, including from day one of law school. Bad decision making in the past shouldn't be repeated. In fact, isn't that what we should have learned from? Besides, we pick and choose when to use it. Why did we use precedent to uphold court cases in certain situations and abandon it in others? Why wasn't Plessy sufficient precedent for Brown? Roe didn't seem to need a precedent when the court wanted to engineer a right to an abortion. I (somewhat) digress.

Frum is also mixing things up. The 5th amendment clause he is referring to applies to takings, which applies to things taken for PUBLIC USE, not things shut down due to government emergencies.
