How was an arbitration appealed?BMX Bandit said:
It was an arbitration. Already appealed. Not being reduced. GEICO not ordered to pay anything
Wow. Guess binding arbitration has changed a bit since I was practicing if that happened.BMX Bandit said:
Winner sought to confirm award. GEICO fought it. They had no basis to do so. Lost at trial court & appealed
BINDING arbitration. Have reviewed and written enough contracts to know the difference. Means no court appeal.BMX Bandit said:
How so? Always been that way.
People have been appealing arbitrations they think are unjust socks arbitration started. (Usually without success.)

Sorry. That is one screwed up case then. Can't tell you how many times I was paid to just sit in a courtroom to watch proceedings just to ensure the interests of the insurance company were protected and the case steered out of coverage issues.BMX Bandit said:
Not following you. Sorry.
Biding arbitration still has certain limited ways to get a court to overturn it. That's not a new thing.
GEICO tried, and lost that attempt. (They weren't even in the arbitration. They sought to intervene afterwards)
LOL. I have also been dispatched when they denied coverage. Guess the 80s were different for insurance defense work.BMX Bandit said:
Insurance carrier denied coverage. (As they should have I suspect)
They don't get to steer anything when that happens.
