How is a firearm purchased 11 years ago, in what is called a legal purchase (in Ohio), so quickly be traced to the purchaser (Frank James)?

NICS records are only retained for "Disapprovals", as it should be.
4473's are only required to be kept 5 years by the FFL, but can be kept indefinitely.
NICS records retention

Edited to add purchase location.

Purchased from a Pawn Shop in Ohio, correct?

He was also on the FBI's watch list.

Tell me if you've heard this one before.

Not surprised. He is a black supremacist. His FB was filled with anti white racist screeds.

He filmed himself walking down the streets in NYC cursing and hurling racist remarks at white people.

FBI needs to be disbanded.

We are required to keep them for 20 years and then we can give them up to the ATF. I'm actually doing a trace right now from an ATF request.

For a high level crime or investigation they will call and stay on the phone with you until you get them the information. I've only had one of those thankfully.

They can find out within 20-30 minutes as long as the store is open and the FFL's records are in order.

This doesn't surprise me. Whenever an FFL closes those records go to the ATF. Whenever there is a multiple sale that record goes to the ATF. Whenever there is a multiple long gun sale in the border states, those records are sent to the ATF.

So how do they know which store had the gun in the first place? Do the manufacturers/wholesalers report that?

Yes. Cops find the gun, they start at the manufacturer and work their way to the store it was sold at. After that it depends on if the owner kept a good record of when and where it was sold.

My son told me last night that he got stopped last month and when the cop engaged he asked for his DL and insurance, then he asked if he had the Glock that I had bought him for a birthday in the vehicle. This is the 1st time I've heard of this. We had put the Glock in his name st the gun shop.

Did Frank James drive for InstaCart? See the excerpt below from a Daily Mail article.

https://www.dailymail.co.uk/news/article-10716225/Subway-shooter-Frank-James-ARRESTED-Gunman-NYPD-custody.html
Quote:

.....

In the March 20 video, titled 'STOP ONE COMPLETE', he gave an ominous warning about his plans. Speaking from the driver's seat of a rented van, he said: 'As I leave the state of Wisconsin, about to be back in the state of Illinois, all I can say is: Good riddance. I will never be back again alive to that m*********r.'

At the start of the video, he told of his plans to drive to Philadelphia.

'I am on my way to Philadelphia. I packed my bags. I got up, even though it's rainy, go to my storage unit, loaded that up and then finished my apartment off this morning.

'I am on my way to Philadelphia. I should be there... I'm going to take my time though.

'This is the first leg of my trip, it's been a long time since I've had to drive this far. We're going to find out though.

'All my Instacart driving paid off or what. We are definitely going to find the f*** out.'

Two days before the shooting, he posted another video where he said black people were forced into violence by racism.

'This is what white b*****s and white m*********ers' expect you to be… when you blow one of their f*****g brains out this is what you asked for. This is how you wanted me to be, obviously,' he said.

He was drinking white rum and had finished the bottle.

Although the shooter was black, he was influenced by systematic racism and provoked by the white man. So this is another act of violence by whites.

Everyone with a FFL has to keep records. When a trace is requested, it goes manufacturer>distributor>retailer>first purchaser

Used guns are much harder to trace since the custody chain was broken at some point

I tell my wife this is why I can't sell any of my guns. Anything a buyer might do with it in the future could come back to me.

Man have I been asleep that long? When did Ohio become a southern state with lax gun laws? Did we annex Canada and increase our statehood geography northward to make that happen because last I heard from the news was that southern gun laws are what caused this NY shooting.

Yes, and I just don't understand how he was able to carry it into a gun-free zone. They have laws to prevent this!

Man, I'm starting to get really interested in private sales. I wouldn't mind flipping over most of my collection for similar guns just to avoid this registry.

I know there are laws about fraudulent sales that I would have to be careful of, but selling my Glock tomorrow and buying a different one in a private sale next year seems to be tough to pin anything on you.

You are correct.

The only guns that can really be traced are new gun sales thru 4473s. I have bought one new gun from a gun shop in my life and that was my son's deer rifle a few years ago. And I only bought it new because I couldn't find it used.

I do not recall ever seeing the ATF successfully trace a used gun through 4473s.
