WATCH: Kristi Noem signs Protect Fairness in Women's Sports Act
by Luke Gentile, Social Media Producer | February 03, 2022 04:53 PM

"Any interscholastic, intercollegiate, intramural, or club athletic team, sport, or athletic event that is sponsored or sanctioned by an accredited school, school district, an activities association or organization, or an institution of higher education under the control of either the Board of Regents or the Board of Technical Education must be designated as one of the following, based on the biological sex at birth of the participating athletes," the law reads.

Designations for sports include females, women, or girls; males, men, or boys; or coeducational or mixed, according to the law.

"Only female athletes, based on their biological sex, shall participate in any team, sport, or athletic event designated as being for females, women, or girls," according to the bill.

Biological sex refers to the sex listed on an athlete's birth certificate, the law reads.

"This is about fairness. Every young woman deserves an equal playing field where she can achieve success, but common sense tells us that males have an unfair physical advantage over females in athletic competition. It is for those reasons that only girls should be competing in girls' sports," Noem said. "Women have fought long and hard for equal athletic opportunities, and South Dakota will defend them, but we have to do it in a smart way."

Protections and injunctive and/or equitable relief are written into the law to provide consolation to those who are victims of violations of the act.

Noem vetoed a similar piece of legislation last year, but the governor said this new law does not contain the "flawed provisions" the bill from last year had.

"This legislation does not have the problematic provisions that were included in last year's House Bill 1217," Noem said. "Those flawed provisions would have led to litigation for our state, as well as for the families of young South Dakota athletes male and female alike."....

She's already showed her hand, and is just trying to be relevant again with the election coming up. She is the Crenshaw of the Red North.

Still wood, though.

I'd still vote for her over some, but we already have better alternatives in Trump and DeSantis.

I think Noem got dropped\doxed\cancelled by a group of people that are so hyper charged that they don't even research and think for themselves. Just as this article says, the legislation that she originally vetoed had bad language in it that opened the door for litigation. It was a rushed bill. She vetoed and said do better. The super charged American public dropped her and cancelled her because of that. She is a heck of a conservative despite how quickly everyone dropped her. This bill is a lot better than the original.

title IX lawsuit and ACLU-instigated rights lawsuit, coming up

but someone needs to start the ball rolling
If gender is fluid then I'm not funding womens sports with football money. Title IX should be voided.

I think Noem is the exact opposite of Crenshaw. She won a power struggle against the SD House and signed a bill that's better than what they previously sent her.

As a conservative leader, she's refused to shut down SD for COVID-19, stood with Trump following the election, and sent SDNG troops to the Texas border. Noem may have flaws, but being Crenshaw is not one.

There's one thing that puzzles me.

I know a few people on the left, but not that many, and plenty on the right.

I have never run into anyone who thinks that allowing genetic males to play on women's sports teams is a good idea.

I'm really curious about who thinks that this crazy scheme has ever been a good idea.

eric, you're not going to run in those circles of people because you're not a communist. The people that think transitioning males should be allowed to play and dominate women's sports are those who want to fundamentally change the US into Communist China. They are not sympathetic to the trans community, they just want to tear the country apart.

Lol, no. Go back and read the original articles on what happened.

She wanted collegiate athletics dropped altogether from the original bill. Why? Because of the threats from the NCAA and corporations. Lots of money involved, so she buckled.

She will not stand on principle. She has proven that. Hopefully her career ends at the governorship. She's cut from the same mold as W.

Yeah but 81 million supposedly voted for the dementia idiot that has put it openly at the top of his agenda and that was before the election.

On Noem she caved on the first bill. She guessed wrong on the issue and was trying to gain national favor. It was a dumb move.

Lol.....if you think she is cut from the same mold as W, I don't know how to have a conversation about her with you. I'm not going to die on this hill, but she is a very conservative leader. She's better than 99% of what we have serving at the moment but mental midgets latch on to one item and make it the gospel. Carry on.

Aren't there nutballs out there who just won't put the sex on the birth certificate because they want their child to choose later?

The first "gender girl" bill had flaws. Read it.
