The retailer responded by filing a response listing out numerous rebuttals and denials to allegations made against it. Those included denying that employees from several stores across states were sent home, disciplined or fired for refusing to remove BLM face masks and shirts dating back to 2020.

It further argued that "employees do not have protected right under Section 7 of the Act to display the phrase 'Black Lives Matter' or 'BLM' in the workplace. WFM maintains a neutral dress code that is lawful under extant Board law."

A spokesperson for the grocer released the following statement:
"Our dress code policy is designed to ensure we are giving Team Members a workplace and customers a shopping experience focused entirely on excellent service and high-quality food. We do not believe we should compromise that experience by introducing any messages on uniforms, regardless of the content, that shift the focus away from our mission."
HEB grabbed the narrative here when they issues "Be The Change" t-cherts and created a fund of the same name to donate to racial causes.

Whole Foods used to be owned by a group that was pretty normal despite the fact taht WF was the store for the NPR bunch.

They created insurance health plans that allowed employees to save money if they didn't smoke and weren't obese.

I applaud them again.

Meanwhile, I entered my third Chick Fil A location yesterday where I noticed that not one single worker inside or outside the store was wearing a mask. Not a single mask in sight on a store worker.


It was refreshing to see a national corporate chain take a worthless piece of cloth off their workers so that they can get back to doing what they do best. Welcoming customers and thanking customers with their smiling faces.

Not a surprise to see CFA take the lead on this. It's a very weird situation we've created were the "servant"working class is made to wear a mask around unmasked customers.

Oh, and thankful that CFA creates a company culture that likely doesn't have to deal with workers wanting to wear any kind of political attire, BLM, Pride, Antifa, Trump, Donkeys, Elephants, nothing.

When I go into eat or shop somewhere, not knowing the political leanings of my waiter, cashier, or the store I'm in, is a good experience in my book.

Surprised and grateful Whole Foods is holding the line. Now they just need to follow CFAs lead and throw the worthless masks in the trash.

Applaud Whole Foods for this. It's the only sane, logical policy you should have. Otherwise, you would have constant conflict in the workplace.

CFA didn't exactly lead with anything. Their stores are still mostly closed to foot traffic. That started in march 2020.

Went to RBFCU yesterday, on Nacogdoches, and the lobby was closed "due to COVID and staffing issues". They made sure....even with "staffing issues"... To waste a staffer by making them stand outside to make sure we knew they were closed in the lobby.

Here in New Mexico Chick-fil-A workers all wear masks...even outside. They were one of the few places that enforces them inside for customers as well. I couldn't believe it.

I guess each "owner" GM gets to decide and the 3 closest to us have decided on no masks or perhaps it's mask optional and all three stores happen to be staffed up with people that are over it.

Regardless. It's refreshing for my week to week life. I don't anticipate a CFA New Mexico run anytime soon.

It's not necessarily Covid keeping those stores closed. CFA has figured out that they can push the same amount, if not more, volume strictly through drive through.

I read they are now piloting branches that don't even have in store access because it's been so successful. They can push same volume and reduce their fixed costs on store footprint.

Whole Foods isn't fighting this due to some ideological disagreement with BLM. It's fighting this in its efforts to keep unions out. It's no coincidence this is all sitting with the NLRB. Here's why.

When a union tries to organize an employer, often the organizers will encourage the workers to wear union pins, shirts, etc. in a show of solidarity. The employer in return typically points to its uniform policy, which prohibits wearing of non-business related pins, hats, buttons, shirts, etc. and will discipline any employee violating the uniform policy. The union will file a ULP (unfair labor practice) charge alleging a violation of Section 7 of the NLRA.

The question becomes, "did the employer always enforce its uniform policy or just against union supporters?" If it's the former, the ULP is dismissed (in sane times). If it's the latter, the employer has committed a ULP.

Whole Foods is trying to uphold its uniform policy - plain and simple. It will point to this effort the next time the UFCW, RWDSU, SEIU, etc., attempts to organize a store or distribution facility.
