SB8 will eventually get struck down and California knows it. Even the conservative justices on the Supreme Court saw this is exactly what liberal states would do.

Maybe what Hawg or the legal braintrust here can chime in, but it seems to me there are a couple big difference between what the SCOTUS said on SB8 and what California is saying here.
  • The supreme court never said there couldn't be federal judical review. They said there couldn't be federal judical review without a plaintiff
  • Protection of Lawful Commerce in Arms Act is actually written into law and bars the suing of manufacturers for a violent crime.
  • Abortion protections aren't written into federal law
