"Fulton County District Attorney Fani Willis sent a letter Wednesday to state government officials, including Raffensperger, requesting that their offices preserve documents related to the call, a state official with knowledge of the letter said.

NBC News verified the contents of the letter, which explicitly states that the request is part of a criminal investigation into several possible charges, from false statements to "any involvement in violence or threats related to the election's administration."
A spokesperson for Georgia Attorney General Chris Carr's office confirmed that it received the letter and that officials "are in the process of reviewing and synthesizing" it. Gov. Brian Kemp's office also confirmed having received the letter."

as an aside, personally, I don't believe in the "secret pardon" arguments. Where is it kept that no one knows about it? Trump would have to prove he signed it when he was president. That would be more trouble than its worth it would seem.

I disagree. It would be really easy to video yourself signing it in the oval office or in the residence prior to leaving DC. He also could have done it on AF1 during the flight. It would be simple enough to call the comm center on a speaker phone for verification of the date and time.

Just stick it in the safe and never worry about it until you need it. It seems prudent to me.

A president shouldn't be calling a state to ask for votes to be "found". It's absurd to think that's appropriate and absurd to think it shouldn't be investigated.

An election official shouldn't accept or count ballots that were 'found' without a set of accompanying chain of custody documents, as required by law. It's absurd to think that's appropriate and absurd to think it shouldn't be investigated.

To break the law, he'd have to specify doing this by unlawful means. A recount could theoretically be a lawful means to attempt the same thing, so there is no reason to presume it was asking for a criminal act.

In other words, the margin is narrow and if that many or more votes are found by a recount that net change, the outcome will change. All the number does is state how narrow the margin is.

I can see how it can be argued as a request to commit fraud, but the wording also leaves open the possibility it was an appeal to use legal means to verify the small margin might be overturned if at least that many unlawful or uncounted votes were found by investigation or recount.

Sketchy or not, there's NO WAY it passes a beyond a reasonable doubt test in a criminal prosecution.

This doesn't come close to clearing the bar for incitement. He could just be saying that you don't have to find all the illegally cast votes just enough to flip the election.

Also, it was clear to all those involved that Trump didn't have the power to order anything.
