He's in jail. Not convicted. Typically you can post a bond to release the accused on bail. I'm asking why can't they do that?

A habeas motion is basically saying there's an unlawful restraint on somebody. Habeas corpus means "present the body" and show why the government has the right to restrain this person.

In most cases, the obvious answer is "because they committed and were convicted of this crime". Not sure what's going on here since he hasn't been convicted.

There was no basis to deny the extradition. It's a ministerial issue that has nothing to do with the merits of the charges against him

His bail is set at $2,000,000. Both Illinois and Wisconsin are cash bail states, so the entire $2,000,000 has to be posted. If he appears at all the proceedings he's supposed to after posting bail, he gets the money back.

Can't pardon for state crimes. The governor would have to do that.

Based on his legal defense fund, he should have no problem posting that bail. Cash bail was set back in September. He's going to a juvenile cell/unit, not an adult one.

His attorney's imho sort of pushed beyond what they should have in going after some of the substance of the charges in the Habeas proceeding. Bottom line is (not sure of the procedure in WI), he should be out by Monday afternoon...

I would think he would get a change in venue in Wisconsin. Even if he is acquitted in WI, I am sure that IL has a weapons charge waiting for him.

I thought that Illinois dropped the weapons charge.

No surprise here, they were never going to win that writ, but you take every procedural step available to you.

My understanding is that there could be no gun charges in Illinois because the weapon carried by Rittenhouse belonged to a friend of his in Wisconsin. The gun never crossed state lines.

He was over charged so he would get acquitted, and they have another reason to continue rioting. Riots are more useful to the left than a conviction

I don't know anymore than what is in the tweets but it sounds like the defense attorneys were asleep at the wheel. They should have already had a stay motion drafted and should have filed it with the appellate court within minutes of the extradition ruling. Not sure why anyone would think waiting until Monday was acceptable.

Will be interesting to see how their system handles his confinement, on charges that carry up to a life imprisonment sentence.

Needless to say, in Texas a $2M bond under remotely similar circumstances would be...highly unlikely/illegal. Traveling to blue states always carries risks, especially with respect to fire arms.
