I would have my doubts on a government intercept. Without a warrant to at least the delivery company, this would be very problematic. Plus, it would scream the question, "how did you know about the delivery in the first place."
If I were Tucker and Fox, I'd be sending out a host of Federal Rule 27 Pre-litigation deposition petitions to both the FBI and the delivery company. I'd want as many people on the record as possible. Obviously, this won't happen quickly, and the obvious place to start is at Fox. Bring in an outside investigation company and go to town.
