In short, drunk driver in truck swerves into on-coming lane and hits motorcycle. Man driving dies, woman passenger seriously hurt and loses unborn baby.

Why would you get on a death-mobile when you are pregnant (especially 7 months !) ?

No charges will be pressed. The drunk driver is an "undocumented" worker. He will, no doubt, get off scott free. (ICE had asked for a detainer as well, but the police refused, so expect a lawsuit.)

Yes, the drunk driver can be charged for intoxicated manslaughter of the unborn child under a law that became effective September 1, 2003 that allows the protections of the entire criminal code extend to "an unborn child at every stage of gestation from fertilization until birth." The law does not apply to "conduct committed by the mother of the unborn child" or to "a lawful medical procedure performed by a physician or other licensed health care provider with the requisite consent." (SB 319, Prenatal Protection Act)

My wife and I both ride. When she found out she was pregnant, she stopped riding. The doctor had told her it was safe through the first two trimesters, but she did not want to risk it. She started riding again when our daughter was about a year old, but neither of us ride nearly as often as we used to.

In Texas, a fetus has the full rights of a living being with the full applicability of the Texas Penal Code in crimes against fetuses (fetii?), other than actions taken by the mother against the fetus or a physician performing an authorized and recognized medical procedure.

although I moved away from Lake Travis a little over a decade ago, the dumb ass bikers that were out there each year while ROT was going on,...were pretty much a gathering of scum
