Read this in the paper yesterday.

They were sued for the same thing about a year ago I think. It was "settled" out of court.

Sounds like the company knew the slide was a hazard based on past experience and still allowed people to use it which caused significant personal injury. Why am I outraged by this lawsuit?

We all get disgusted by these lawsuits, but it is company choices that allow them to be won.

Even in the infamous case of the McDonald's coffee; McDonalds knew their coffee was too hot (capable of 3rd degree burns and burning the throat and mouth), knew that people drink it in their cars, and that the location of the warning was not in a place where the drinker could see it. They still chose the course of action that would lead them to court and lose.

Seriously, a slide is intended for children to use. One that has broken two legs (when being used properly) sounds like a bad idea to me.

Just reached out to a friend who managed recruiters there until last month and he shared the following

- kid was not allowed on the slide and she was aware of the policy and with the child at the time
- she is being managed out for other reasons and knows her days are limited

Surprised when I read about this lawsuit as well.

My initial thoughts were:

#1 - why sue your employer - that can't end well?

(Reviewing Glassdoor about rackspace sounds like more people are running from there like ants from the Orkin man, so she'd be lucky to get $200K if the company goes under or gets bought as people are saying.) Noyt to mention the public backlash - whether she is going to be managed out as people suggest or simply let go due to public embarassment.

#2 - as a parents - would you really let your 19m old go down a 2 story slide, really?

#3 - this happened 2 years ago and i would guess medical bills have been paid by now - alot of facts change over 2 years - why go through the trouble of suing?

What am I missing here, how is it wrong to sue Rackspace over the slide?

1. They knew it was dangerous as it had already broken a leg
2. They thought the proper corrective action, rather than to remove the slide, was to post a sign saying "no kids", maybe failing to realize that an 18 month old can't freaking read and the leg it already broke was an adult's.
3. The amount isn't really high considering that a broken leg on a toddler will absolutely lead to medical bills over $200k.

This isn't a playground, its a workplace. While it may be cool and hip to have a slide, the thing is breaking legs. The injury was 100% forseeable, actions to make it safer were a joke, it serves no business purpose

IN McDonalds an old lady had her Va-ja-ja burned off by their coffee. Took multiple skin grafts. The store had been warned and cited multiple times and refused to lower the temp. The coffee was being served at almost 200 degrees.

Someone give me a good reason why this is a bad lawsuit, aside from your typical "this is texags and I am programmed not to think about anything myself just top regurgitate the same old crap."
