Disorderly Conduct - Loud Noise

How long do you want to ignore this user?
So my roommate got a citation for tonight for "loud music" at a party at our house. The officers came into our backyard through the open gate, and grabbed my roommate by the shoulder as he went into the door claiming "probable cause" for the ticket. Also the officer was insistent that my id was fake and repeatedly tried to get me to confess to it being fake, until finally running it to find it was real. What is some advice for handling this in court and the ticket?

Why was the gate open? I'm not sure about ways to fight it, but good luck for your buddy getting his CHL if he wants it anytime soon. Noise violations within like the last 5 years I think stops you from getting it.

Probably not much you can do on a noise violation. I have always heard horror stories about CSPD, but thankfully the only time they showed up at my house I just sent everyone home and they didn't even check IDs or talk about noise violation. I was definitely in the minority.

I thought they normally gave a warning the first time they were called out on a noise complaint.

I'm guessing there is more to this story. Like maybe a neighbor called in a complaint, therefore the police responded. Maybe the officer tried knocking and ringing the doorbell, but due to the loud music no one could hear it, therefore the officer went in through the gate. Maybe your roommate tried to walk away from the officer, therefore the officer had to grab his shoulder to keep him from waking away. Maybe your roommate was acting like a self entitled brat and being rude to the officer, which led the officer to write a ticket instead of a warning. Maybe your ID has so many cracks and wrinkles from being drinkenly shoved in your pocket that it is hard to read, therefore the officer thought it was fake.

Can I prove any of this? No. But I am willing to give the officer a little bit more consideration than a student who is whining because their party got busted.

I guarantee aces is right. There is always more to the story.

I love threads where people whine about how unfair the police are. Somehow I managed to get through 4 years in CS without having a single negative experience with the police.

Haha, not in College Station there doesn't have to be. CSPD used to have a "Loud Noise and Party Patrol" that drove around with their windows down busting parties. If they could hear your music or people talking when they drove by it was considered a "noise violation" They would brag in the Battalion about how many noise violations they'd write over the weekend.

I was at a least a dozen parties that got noise violations the first time the police showed up. Usually they'd write one for every person that lived at the house. One time there were 8 people at my friends house at 9:30, we left the front window open, no music on. Cop said he could hear us carrying on from the street and wrote a noise violation for all 3 people that lived at the house, $350 a piece. We knew all the neighbors, on one side they were out of town and the other they were at Northgate so there was no way they called. He was just driving by and heard us talking loudly.

Here's one of the articles on it, sorry it was actually called the "Noise Abatement and Alcohol Task Force" They would drive around just looking for parties, walk right in without saying anything and write tickets.

You whiners think it's just CSPD? Think again. Tucson pd has a helicopter dedicated to searching out parties. It happens everywhere. By not being a jackass I managed 5 years of nothing but respectful encounters with CSPD.

Thanks to our convoluted legal system, the two bold items are somehow in the same category. Makes sense doesn't it??

That's what I did, never had any negative encounters with Bryan PD. Step across the city limit line to go visit friends and it was completely different.

OP, I work for the court in CS.

Nothing I say here can be taken as legal advice; i'm not a lawyer (yet!).

Here's what is going to happen:

Take it to a pretrial conference. There, talk to the City Attorney and she will give you a 25% off discount. The Court definitely looks down on "party crimes" (noise complaints, alcohol related offenses etc) and there is very little leeway.

Do not take it to court, just talk to the CA like I said above, and get deferred adjudication. Basically keep your nose clean for 6 months and your ticket goes bye bye so long as you paid it.

Speaking of, it sounds like you're gonna be paying about $350 for the ticket. Court costs are so high because the Legislature sets how much you would have to pay. It's pretty ridiculous and no one knows about it.

When you go in front of the CA, do not mention the whole "cop kept trying to tell me my ID was fake" story. There is no way to prove that and even if you did, it would not mitigate your loud music.


If I were you, I'd pay half the ticket, and then lock my **** up. Especially the gate. If the cops show up go inside, turn the music down. Don't answer if they knock on your door.

It isn't difficult to have a party and not disturb your neighbors.

Keep music at reasonable volume
Tell your drunk friends to STFU
After 10:30 move it inside or turn the music really low or off and tell your drunk friends to STFU

Not that hard of a concept.
