Because the police cannot take someone else's video and use it to prosecute someone, unless the person who made the video is willing to show up in court and validate the video. Which TV companies aren't willing to do. So the cops need to personally witness the bootlegging, get a search warrant, etc.

So why can't they just follow and find out where they make it. Wait it out and then bust them red handed?

Maybe that would be to easy.

It doesn't matter if a tv person doesn't want to come to court. You can subpoena them just like anyone else. And if all they are doing is being used to put a tv show clip into evidence they aren't going to put up a huge fight. Obviously the show is fake or there is some agreement with law enforcement.

Cops only get basic cable.

The whole thing last season was they could go legal. So I'm sure discovery pairs the fees and got the legal stuff out of the way and then paid off whoever the land owners were therefore no trespassing or illegal distilling happening.

Now how much they told them or what not is another question that I would hope to be not much. Therefore there is some reality left.

What the show is, is people with a license and are allowed legally to make their own alcohol or moonshine acting like they are moonshiners.

They own their own business and typically make it in a totally professional manner. The show pays them to put on overalls and go out in the woods to mimic how a moonshiner WOULD be making alcohol.

However all the drama of them being scared and looking out for the police and all is just added to show what it would be like to do that in real life.

At the end of season one they showed one of the guys applying for his license so he could make moonshine legally. This was to make it look more legit if you happened to look up the guy in real life and say he owned a whole business making alcohol legally. In reality he had the license all along.
