I don't drive drunk and I think people that do are idiots, but stopping every single person just to see if they are drunk is a violation of the bill of rights and is despicable abuse of power.

Maybe we should start having weekly house checks to make sure no one's hiding any dead bodies

It's the word "unreasonable" that gives the authorities the wiggle room they need.

It would not be unreasonable to expect a significant increase in drunk drivers a couple of blocks away from a bar right after last call.

Of course, IMO, the left is much worse than the right about it, but I'm sure there is a tidal wave of people who say opposite.

Even though they can probably only bring up this case and the wire tapping.

To pull you over and investigate you for intoxication, a cop needs to have reasonable suspicion that you are driving while intoxicated. For example, if you are weaving within your lane while driving under the speed limit and tapping your brakes for no reason and it happens to be 2am on a Fri/Sat night...all of those things combined can be enough to give a cop reasonable suspicion that you are DWI and pull you over to investigate, even though technically you have not broken any laws justifying a stop.

A cop can also pull you over if he has probable cause to believe you have broken a law (e.g., you are speeding and he catches you on radar). When he walks up to your window and smells alcohol on your breath, he can then investigate whether you are DWI, and if you fail the field sobriety tests, he then has probable cause to believe you are DWI and can arrest you.

Simply driving at 2am on a Fri/Sat night, by itself, does not give a cop reasonable suspicion or probable cause to pull you over. If he does, on that basis alone, then any decent lawyer will have all the evidence thrown out and the case dismissed.

Border Patrol checkpoints in Arizona are a big pain in the arse, and a lot of those guys think WAY too highly of themselves and are annoying jerks.

I've made & been in those drives to and from SoCal too many times to count over the last 10 years and have been detained about 12 times that I remember. These were with me driving by myself with my dogs in an SUV, with a friend & my dogs in same vehicle, in a tour van & a tour bus with the band. Every time it's a 20-30 minute stop with ridiculously ****ing stupid questions, dogs sniffing around like we'd have a kilo or 2 lbs of grass or 3 illegals in a guitar case. (anyone with half a brain knows ways around that if you are holding anything). I've never acted like the guy in the video, but if you make that drive regularly through there, you'd understand a bit better.

Also, the last time I was detained in one of those stops they asked the usual "do you have any guns, etc" and I did and told them it was in the console. Well, they did the whole drug sniffing dog check and never even looked at the gun. I found that funny.

Okay, I finally got to the next part where he's ****ed up, and yes, the Yuma checkpoint is the worst one, and he is dead on with the dog bullshat. Again, I usually have my Ridgebacks with me when I'm making that drive and I've NEVER seen their dog do the typical alert response that trained drug dogs do when they smell something. It's usually preoccupied with my dogs, one of which doesn't like anyone/dog he doesn't know getting too closed to me, so that's always fun as well when I have to keep him from going apeshat on La Migra and their dog.

That sounds like complete bull**** that they can say their dog reacted to something in the car that alerted them. They could lie about that and then have reasons to search. How can someone actually prove whether or not the dog reacted other than by the cops testimony?

Yep, it's complete bullshat. Those dogs are typically trained to stop/sit & bark or paw at the point they smell something. Another bit on the last time I was stopped near Yuma, again I've come to almost expect the detainment stop, so I made sure I had gotten food outside of Yuma to eat at their lovely little tent/bench waiting area. I also had an 8 ball in my hiding place (properly scent proofed of course). Their dog didn't didn't do anything of course, well except for sniffing my dogs bones & blankets. I ate and took some pictures with an agent who was a fan, drove off & took a bump a 1/2 mile down the road.

And the point of mentioning that is that using "the dog detected something" as their probable cause is a joke and I'm sure 99% of the time they use that line with people, it's complete bullshat. The dog didn't detect anything other than 2 dogs it wanted to play with in the above situation. And again, I had a loaded .45 in my console that I told them about and they didn't even bother to look. Hell, I should bring an AK next time.

It isn't illegal to have a gun in your car. Why do you want them to inspect it? They ask for their own protection, not so they can confiscate or register it.

I know it's not illegal, but they do tend to take a look, especially when they have a dog perusing on & over your seats and when they are looking in the glove compartment, door slots, etc. At least the other times I've been in a similar situation they did.

Drunk drivers need to be pulled from their vehicles and beaten with axe handles in front of God and everybody. Fewer people would risk driving drunk.
