Sec. 202.011. REGULATION OF CERTAIN ROOFING MATERIALS. A property owners' association may not include or enforce a provision in a dedicatory instrument that prohibits or restricts a property owner who is otherwise authorized to install shingles on the roof of the owner's property from installing shingles that:

(1) are designed primarily to:

(A) be wind and hail resistant;

(B) provide heating and cooling efficiencies greater than those provided by customary composite shingles; or

(C) provide solar generation capabilities; and

(2) when installed:

(A) resemble the shingles used or otherwise authorized for use on property in the subdivision;

(B) are more durable than and are of equal or superior quality to the shingles described by Paragraph (A); and

(C) match the aesthetics of the property surrounding the owner's property.

They can't stop you from installing solar, but they can outlaw metal. Check the covenants. My HOA covenants specifically prohibit metal except unpainted standing seam, which is what I went with. You could always try to submit for a variance and make the case that a metal roof adds more value to the home and thus increases neighborhood property values. The worst they can do is say no.

Yes, they can have a say so on roof colors. Recently replaced mine, and anything we do to the exterior of our house or property has to be formally approved. And that includes roofs and the color (which I had to submit and get approval on, as I was changing the color).

I ALWAYS apply at customers HOA. It's a pain in my tail but they do make the call on approval of shingle or roof materials. Some charge. Even after thy email and tell me approved shingle brands and colors, I STILL have to formally apply for the customer.

I'd say your statement of easily getting around it is not going to validate. Going from an approved black shingle to galvalume metal roofing is about as polar opposite as it gets and I doubt an hoa is going to allow that for aesthetics and uniformity.

An HOA might agree to it. Depends on who is on the architectural control committee and how tight a ship they run. Some would reject it out of hand, but some will rubber stamp anything.

As for the black only shingles, that neighborhood must look like *** with the lack of variety.

Variety is tough because there usually isn't a ton to begin with. You get 8 houses in a row with weathered wood and then someone tosses a pewter in and it looks like crap. You need a ton of variety for it to work not just a few one offs.
