The Employee Retirement Income Security Act (ERISA) is a federal law that establishes minimum standards for private sector retirement and health plans. ERISA was enacted in 1974 to protect individuals in these plans.
ERISA requires that plans:
- Provide participants with information about the plan, including funding and features
- Set minimum standards for vesting, participation, funding, and benefit accrual
- Hold plan fiduciaries accountable
- Establish a grievance and appeals process for participants
- Allow participants to sue for breaches of fiduciary duty and benefits
- Guarantee payment of certain benefits if a defined benefit plan is terminated
