In a Will, should the header where it says:

STATE OF TEXAS


COUNTY OF XXXXXX

be the county where you live or should it be the county where the notary is where you have it notarized/witnessed?

My wife and I are making a minor adjustment to our Wills and this is regarding the "Self Proving Affidavit" sheet. I am having an attorney review and I would like to avoid a re-do/rework over something like this. This was the only thing I am not sure about.

Just paying for of a review of what I changed. I PDF converted old Wills (originally prepared by another attorney 20 years ago) to .doc and changed the small item in each. I am paying for a review/read-over only.

I want to go in, pay for the 1hr or so review, sign, notarize, and get out of there for the fee I already agreed to. I don't want a dumb hangup over this one thing that I didn't have the answer to end up turning in to "let me go ahead and sell you an estate planning package" and turns it into 10X the cost. Just a having my ducks-in-a-row sort of thing.

Nobody can answer with without seeing the actual document. It sounds simple but its one of those things.

It doesn't matter near as much as you think.

Just use the county where you live and likely own property. That's where the probate is going to be filed.

The notary is irrelevant to the header. The notary's sole purpose is to confirm that John Doe signature really came from John Doe, not somebody else. That's it.

They can notarize the document from anywhere in the state of Texas. Their section has a spot for the county where they notarized/confirmed the document.
