Is this something where it's a matter of just checking boxes, or is it best to get an attorney?

It's not easy to get done. I'm assuming you have been working with a dealer?

Yes. Transmission has had issues since we drove it off the lot and they can't fix it after many many tries

"I don't feel safe driving this" say that a lot

If it's a new vehicle google texas lemon law and start the process with the state.
You can ask for a buy back which is basically the same thing.

If they've actually tried to fix it and failed, you're golden. I think it's 3 or 4 times in 12 months.

Here is a guy that handles lemon law cases out of Houston:

Jeffries Law, PLLC

Note, I did not use him; I only talked to him. He was very informative and professional.

The reason I didn't use him is that the dealers refuse to fix my vehicle. They actually have to make a repair attempt for lemon law to kick in. I also have transmission issues. They claim harsh downshifting with a loud clunking noise is normal, thus they would not try a repair. Well, one of them did try to reprogram it and that didn't work. In fact , it made it worse. Then that dealer said it was no longer happening when they drove it. A lie.

Good luck. I hope you can get it lemon lawed! We need much better consumer protection laws with vehicles imo.

And if they tell you that they cannot replicate whatever issue you are bringing it in for, they are more than likely using a loop hole around the lemon law.

You shouldn't need an attorney. I used the lemon law on an issue that wasn't even a safety issue. Call Ford customer service and work through them. I found it to be very easy.

I've been out a few years but in my 13 years in a GM dealership I don't remember anyone actually filing any kind of suit under the lemon law. I did twice assist people in lobbying GM for a manufacturer buyback. An Aveo and one Silverado. It took quite a bit of time in the shop before GM agreed. Both times GM sent out a factory technician to look at the vehicle in our shop. Id suggest pursuing that route. Use words like safety and mental health

Reach out to lemon law Larry (https://lemonlarry.com/). I was having numerous issues with my 21 trail boss and came across them on Twitter and decided to take a chance. No risks to you, they will ask that you send them all service paperwork you have with the vehicle. I filed a suit with them in July and in September they reached a settlement with GM for 25k. They did take out 40% of the settlement but I still received a check for $13,500. Was well worth the risk!
