I'm a little confused how a contractor (work at home) can also be an employee (right to organize a union and strike) but it may be legal, especially if the strikers get laid off and file for unemployment insurance where they say "yeah, we were not listed on the quarterly reports as employees because the business misclassified us as contractors"...that would trigger an investigation by the Texas Workforce Comm. (edit- TWC has the power to reclassify Workers to Employee status which would require the employer to go back and add them to quarterly reports, and then triggers the IRS to investigate...and yes, these rulings are subject to administrative appeal, and can be taken to court)
