Heir property with undivided interest. Developer bought out a few heirs and is trying to force out the person actually living there. That's the gist of it

The article literally says this is a statewide issue. Hell, there was legislation passed to try and curb some of it.

Why in this instance are we being told we can only discuss cases with Capps and Youngkin? They are definitely vultures but others have learned from them and are using the same tactics right here in Brazos county.

In my opinion the article was Right On! I know from personal experience! Encourage everyone in the Brazos and Robertson Counties to read, heed & understand what these two characters in the article have been up to for many years!

One thing the article neglected to mention is the untold amount of Mineral Rights that were targeted by these "legal" schemes. The value of those Rights is a big number!

A big thank you is owed to attorneys like Karl Hoppes and Jay Goss who have spend untold amounts of their own money and time defending folks who didn't have the where with all to defend themselves.

It seems like a story this big should be highlighted by our local Brazos County TV and News organizations?

As JudgeTravis Bryan says in the article, "It's not just 'I'm a lawyer and he's my client.' 'They're actually in it together ."

This is a story unto itself. Likely the research would reveal some irrefutable evidence.
Also, there might be some opportunities for original owners' recourse.
Not all operators and landmen pay attention to the details.
Taking on true ownership with the operators is not the same as fighting the state/county/shysters for ground rights
The story does address the split signing bonus. That is a huge tell.

Legalized theft. If you don't have the resources to fight, and they can file as many suits as they want because the lawyer is in kahoots. I'm not calling names, staff…. but I sure want to.

I am not in agreement with these tactics, especially the teaming up with that lady in California. That was weird.

But the important question is: why are African Americans exempt from paying property taxes and keeping up their properties? That's kind of what this article is insinuating.

A lot of these are Chapter 29 actions. That's under chapter 29 of the Texas property code. Check it out…it deals with payment of ad valorem taxes by one cotenant and allows that cotenant to purchase the interest of the non paying cotenant(s).

Some are partitions, which do not dispossess people if their undivided interest, it only turns the partitioning property owner's interest into a divided one. Partition is a right of any undivided owner.

The other is adverse possession, which is a key aspect of our property law system.

These are the result of the diaspora of African Americans from the south to the cities on the east and west coasts. Nobody is there to take care of the properties and taxes are not paid.

However, I think the concerns are the tactics and odd attorney-client relationships. But at its heart, it's due to nonpayment of taxes or absent landowners.

That's how I get there.

To the contrary, the article notes that many of those who lost any claim to property have paid taxes for many years and even lived on it. The shyster extraordinaire made the upkeep remark, which I took to be a bigoted slam.

As noted here and in the article, if you don't know you're being sued and or don't have resources to fight it.... wrong on every level to those who have had their heritage usurped.
