He's also facing charges of attempted capital murder and aggravated assault on a public servant for shooting Trooper Tovar in Grimes County and faces 5 to 99 years or life with the possibility of parole after thirty years for those charges as well, which can be served consecutively to the Brazos County charges for a maximum sentence of sixty years to life, meaning he would be 87 before he's eligible for parole if sentenced to the maximum of life for both shootings and the Grimes County judge runs the sentences consecutively. The Brazos County District Attorney plans on bringing up the Grimes County shooting during his trial.

The capital murder statute in Texas has specific criteria on what is considered capital murder, and non-capital murder is not eligible for life without parole or the death penalty. Capital murder by someone eighteen or older carries a mandatory life sentence without parole if not sentenced to death. If multiple people were killed in the shooting or if Trooper Tovar was killed, he would have been charged with capital murder.

If it was possible, would you prefer him getting the death penalty or life without parole?

I am pro death penalty, but we spend millions with all the automatic appeals. So I vote for life without parole.

Same in this case.

You said you're pro death penalty and you support him getting life without parole if it was possible, but would that only be if he pled guilty in exchange for life without parole to avoid the death penalty, or would you think he should get life without parole even if he was convicted at trial?

Bring back prison working farms in TX. That would scare most bad guys.

Even if he has a trial and is found guilty, I am for life with no parole.

Imprisonment is so expensive so I don't want a 2 or 3 million dollar cost just to execute him.

As noted above, a prison farm would be a great option.

Since he's not eligible for life without parole, what would you think about him being allowed to plead guilty to all charges in exchange for fifty years, since it's extremely likely he would serve his entire sentence? According to the District Attorney, that's the standard plea offer for murder cases in Brazos County, even when there's other charges in addition to the murder, like in Kevin Pullen and Nathanael Tillery's cases, or the murderer has a long record like Terry Ratliff, since they will have to serve 25 years before parole eligibility, and 60 to 99 years or a life sentence requires thirty years before parole eligibility. I don't know if Larry Bollin was offered the same deal or if he was offered a deal at all, though. If he gets fifty years, he would be released when he's 77, assuming he serves his entire sentence.

Or do you think he shouldn't be offered any deals and should get the maximum thirty years to life in Brazos County and Grimes County to be served consecutively, so he would be 87 when he's eligible for parole?

Or would either sentence be fair to you?

I am trying to figure out your angle here and the other thread that you just posted

Dubi explained why but you basically asked the same question

Are you writing a thesis on what texags responses
lethalninja

I was asking Dubi if he should be allowed to plead guilty in exchange for fifty years, since life without parole isn't an option and he would probably serve his entire sentence and it's the standard plea offer for murder cases in Brazos County even when the murderer has other charges in addition to the murder or has a long record, or if he shouldn't be offered any deals and should get the maximum sixty years to life.

I previously asked Dubi about life without parole vs. death if those were possible sentencing options for him.
lethalninja

What do you think: should he be allowed to plead guilty in exchange for fifty years or should he not be offered any deals and get the maximum sixty years to life?
lethalninja
How long do you want to ignore this user?
I'm asking because I'm curious what people think he should get, not for a thesis.

I would be ok with a long sentence that guarantees death in prison.

He was 27 when he was arrested last year, so what's the lowest sentence you would be okay with?

60 would be fine. If he ever gets out there should not be a threat.
lethalninja
How long do you want to ignore this user?
Would 55 be fine as well, or is 60 the minimum you would be okay with? Either way, he would be in his eighties if he doesn't die before then.
lethalninja
How long do you want to ignore this user?
He could technically get five years, cause that's the minimum, but that would never happen.

The District Attorney said his trial has been delayed and there's not a new trial date yet.
lethalninja
How long do you want to ignore this user?
The District Attorney plans on introducing his racist and politically aggressive Facebook posts at trial, according to the notice of extraneous offenses (several of the victims were Mexican). He doesn't have a prior criminal record, but that's not much of a mitigating factor considering what he did.

Have you ever served on a jury before? I haven't, but I've seen several jury selections, trials and sentencing hearings.

Have you seen Law Abiding Citizen? It's not as popular as My Cousin Vinny or A Few Good Men (I know those don't have to do with John Grisham), but it's a good movie.
