Buying Vehicle with Out of State Title/Registration

Buying a truck is outdoors

I am being a vehicle from a private seller that just moved here from out of state. The vehicle has not been registered in Texas yet and has a clear title from previous state of residence.

I can imagine that will screw up the registration process for myself when I go to put it in my name. Advice? Should I have the seller register vehicle?

I bought a truck from a guy in Missouri and the truck was titled in MO. I did not have an issue at all.

I wouldn't imagine it's a problem but I could see it being an issue with the tax office for some unknown reason.

I'd have the seller cure all of that to get a clean TX title for you.

Had experience with this. Look closely on the title. If it is husband AND wife you'll need it cleaned up by the survivor prior to sale to you. If it is husband OR wife, you'll be okay and good to go.

My guesses are as follows:

If the seller (surviving spouse of titled owner) is the executor of the deceased estate and is not listed on the title, then you will likely need:
(1) a copy of the Letters Testamentary/Administration naming the surviving spouse as executor, per probate court.
(2) a Bill of Sale signed by the spouse (might need to be notorized...)
(3) Certificate of Death for the deceased owner.
(4) Maybe a copy of the seller's Driver's License.

If the seller is not the executor, then the Bill of Sale would needed to thru the executor... That person should be the one signing over the title and signing the Bill of Sale. I think you will still need the CoD and Letters Testamentary too.

These are educated guesses based on my experiences. However, you should really talk to the tax office where you plan to register and title the vehicle. They will tell exactly what you need. Every tax office seems to do things a little different (in my experiences of registering about 8 out-of-state vehicles in Texas (Travis and Navarro Counties)).

Also, don't forget to get the vehicle inspected before registering. Good Luck! You can get this done!

Thanks for the info.

Spouse is listed on the title if that helps. Planning on calling the tax office tomorrow.
