I was browsing Jim Willi's site and he does paperwork for individual to individual sales in Texas. Has anyone ever done this? I have a new CGS Hekate I may not use and am considering selling my Sandman S.

Bump. Someone has to know.

Yes. I've done a few Form 4 transfers with another individual in Texas and not used a FFL.

Not for a silencer but for transferable full auto.
It's the exact same process.

What's the processing time like? Same wait as new?

Exact same wait time. Also, as Animal mentioned, no need for a dealer if transferring in state. Can transfer individual to individual on a Form 4. If using a dealer for in state, there's an extra $200 tax to transfer the can to the dealer first. Same would go to selling out of state. $400 in taxes and double the wait time.

Can it be sold trust to individual, or trust to trust?

Yes. Any individual or legal entity can sell to another legal entity or individual.

Put me down for two. Nothing like blowing through $30 of ammo in a couple of seconds.

Sold a can about 10 years ago. I just did it through a class 3 gun store. They held the can and submitted all of the paperwork. The buyer paid a fee to the store. I got my stamp back from the feds about 5-6 months later. It wasn't a big deal, but that was probably because the gun store did all of the work.

Do you sell your stamp as well or is that a tax you just never get back? Isn't it tied directly to the suppressor you're selling?

No. Stamp is yours. I still have it. They say stamp collectors buy them but I've never seen it.

How did that work? Did you transfer it to them on a Form 4 first or did they take it in for "repairs"?

They couldn't have had possession of it during that process unless they did one of those things, and if they brought it in for repairs, they shouldn't have been involved in reselling it.

I hate selling firearms at all, and would never part with a can. Too much time invested in replacing.

But if I was going to do so, I would sell to an FFL to reduce my legal liability.
We may not always get what we want. We may not always get what we need. Just so we don't get what we deserve.

Agree with central here. This is how my buddy has done it.

so here is a related question

Friend is an FFL in another state (me KS, him MO). Offered to sell me a suppressor that is owned under his FFL

When he sells it, he has to transfer it to the FFL in my state, then
  • I fill out the paperwork with them.
  • Pay the $200 tax
  • My state's FFL holds the suppressor until it's done.

Correct?

My friend who is the FFL can't hold it for me (so I could use it when I go shooting with him) until the ATF approves the transfer?
