Someone point me in the right direction on how to read s recently done survey in Texas.

By read, do you mean understand the metes and bounds description? (I.e "start at the corner of ....thence, 700' 36N, thence...."). It's really just knowing where the start point is and then there is a distance along a direction to the next point. Keep following until it closes and and it contains xxxx acres.

The drawn part shows a ROW on three sides of my rural property. One side shows road which is literally hay meadow.


The text tells of easements to an electric utilities. The electric easement on mentions x foot on each side of existing power line. The text also says easement of electric from 123/456 to 124/457 etc. there are no exsisting power lines. There is a old water line. FIL owns the property on the other side.

Problem is that the new neighboring property owner wants to bold a house and run power lines down the ROW. I can't tell if there's an electrical easement or not. He spoke with me many weeks ago and I told him I'd give him an easement that's s shorter distance on the back side of my property. We agreed that he would drawn stuff up and talk it over with me.

Well guess what. He didn't.

The electric guy cane out today and I told him I do t think they have an easement. They packed up and left. I spoke with the electric companies legal department and they said they think they do have the easement but need to run it up to a VP now that someone has challenged it.

I don't want to waste anybody's time, but I don't wasn't to let the new neighbor run lines unless I have to.

And yes I know this is the beginning of a lifetime of bad neighboring.

This (for FIDO). Plus, depending on the type of survey you got, it may not have all of the easements illustrated on it. You'd need to run the title chain at the courthouse to be sure what you're working with. Surveyor might have done that, if that's what he/she was contracted for.

+1 on Todd's comments. Get a title company to re-run the commitment. If there are reference to blanket easements they may not effect you. Easements and ROW can be abandoned over time, but it requires someone filing an instrument or revised plat etc.

Call the surveyor that did this recently done survey. Set up a time to go down to his office and discuss the survey. If you didn't hire him but he was hired for the transaction that you were involved in there shouldn't be a problem with that. And I, personally, wouldn't bill you for that time. It means my survey wasn't appropriately documented for my audience.

If you didnt hire him and you weren't involved in a transaction for which the survey was prepared I'd be ready and willing to cough up a reasonable fee for a short consultation.
