A user on one of the Ohio gun forums I follow on facebook posted the below statement. He is unable to cite the specific code to substantiate his claim. People on the post are 50/50 split believing him. I'm not sure about it. I know a lot of people go to Academy and other firearms stores to do their transactions since seeing a firearm in the parking lot doesn't draw much attention. Does anybody know if this is fact or fiction?

"Just an FYI. I work at a gun shop. In the last week, we've had 2 separate people trying to make a private trade/sale from a Facebook group in our shop or in the parking lot. Not trying to be "that guy", however, that is a felony. If you set up a meeting place to make a deal, please don't get a gun shop in trouble by doing it on their property. Any deal on an FFL property must go through a background check and the shops A&D books"

I've bought a pistol of TexAGs in the champion firearms parking lot after getting half a box of range time in.

I think the guy is full of you know what. Sounds to me he wants the $20 or whatever they charge for transfers.

Note I can see the store having a policy about no private transactions on their sales floor.

Federally, he's full of crap.

Sales of firearms by a licensee at their premises have to be run through the FFL's bound books and a NICS check has to be completed. There may be a state law that prohibits it, but i doubt it.

If you aren't the licensee or an employee of the licensee, you can do a private party sale wherever. Now, the gun store can certainly have a policy that says no private sales on their premises. I can see where they may think they have liability for private party transactions.

Most guys that "work in a gun shop" have no idea about the actual laws and are just spouting crap from customers who come in the store, other guys that don't know crap, and the internet. Few actually read/know the laws associated with the business. That is fully on the FFL for allowing the ignorance.

This was the closest thing I could find. Sounds more like a gray area an FFL would want to avoid, rather than a felony.
