I know this guy http://www.texasnfatrust.com/ He charges between $400-500.

From what I've heard from people that have used other lawyers the prices range from $300-600 to set up a trust. I personally used Quicken Willmaker I bought for $9.99 on e-bay.

You set up a trust to buy a gun that has to be registered by the ATF (full auto, suppressor, etc.) so that ownership of the trust can be transferred without transferring ownership of the guns, which requires re-registering them with the ATF (and paying the fees).

I have had some folks ask in the past, but I had to pass. You screw one thing up and you just might have a client looking at some time in PMITAFP. In my research I think I recall that any entity can be formed to the same effect including an LLC or Corp. I think I'd rather have a client do an LLC because there are a lot less issues with an LLC than a trust (settlor, beneficiary, trustee etc.) Either way, I will not touch these things.

There are some...ummm...ummm...attorneys that do this online. Have fun, but make sure you do it right...that or buy a chastity best for you corn hole.

Jbird, if you are setting one up for a NFA guns you might talk to whatever local Class III dealer you are working with. They probably know the good and bad ones around.

Log sent me to this guy in Dallas for FFL transfer and I found out that he will set up your trust for free if you buy from him.

What does the discussion mean regarding transport across a state line? It indicates you must complete a form and get the approval returned.....even for temporary.....isn't that quite a hassle?

I don't think I'd touch that with a 10-foot pole.

As for Atwell...if he's not a lawyer and he's doing those for someone else I'd think the Unauthorized Practice of Law Committee would want to have a talk with him.

I wouldn't either. I have a good friend that is very entrepreneurial. He has a lot of side businesses in the outdoor arena as well as a rep for a multitude of hunting and fishing related companies. He was a rep and was very successful for several black gun companys....he had a FFL.

He gets a knock on his front door about 9pm one night....ATF. They wanted to look at his records. OK....we will have to go to my place of business. They said no and proceeded to take his two home computers after a complete search of the house. His wife was in the later stages of cancer....did not handle it well at all...they left around midnight. The next morning they were at his office. Every thing was up to speed...no problems whatsoever. Nary an apology.

He dropped his FFL immediately rather than ever face that situation again.

I've been asked to set it up before. Simple trusts are easy and inexpensive to set up. That said, I've always referred these situations on. As an individual, I would pay more money to an established lawyer than go with a young solo or by getting something off the internet. This is one where if something goes wrong you'll want to have solid counsel that you can rely on and will stand up for you. That said, I would think you should still be able to get someone with good experience for $500 to $1k. You may just have to look for a while to find someone who will do it and that you can really trust.

Thanks for all the info so far. I have found one person in Florida and one in Houston that do these, both are around $600.

My thoughts exactly.

$600 as opposed to "subject the individual to confiscation of all firearms, 10 years in jail for each violation, and up to a $250,000 penalty for each violation."

I followed the link to the Houston Lawyer, and noticed that the website didn't provide any information about the lawyer except for her name - Misty Barajas. I checked the Texas State Bar website and there is no Misty Barajas listed as a licensed Texas attorney. It's possible that she is licensed in another state or perhaps is listed with the state bar under another name (maiden name maybe?), but that seemed like a red flag for me. The website also doesn't list any other practice areas and the email address is a gmail account.

Like I said, I know nothing about her, but the website just seemed a little unusual. Like the attorneys above said, make sure you find an attorney you can trust and can demonstrate that they really know what they are doing.

The guy I listed at www.texasnfatrust.com has been doing NFA trusts since they first became popular a few years back. He's probably done more NFA specific trusts than any other out there. He's in Houston and has a Type II SOT manufacturers license so he knows his way around the NFA well. I know him personally and also know at least a dozen people he's put together trusts for. The other two listed I have not heard of before so I can not give an opinion on them.

There is a specific form you must fill out if you are crossing state lines with the NFA items, except suppresors. Apparently if you have somewhere you routinely go with the item, you can put in the date 1/1/10-12/31/10 and not need specific dates. I don't know exactly what the process is for it being approved, or why they wouldn't approve it.
