The civilian version (semi-auto) is certainly legal in Texas. Full auto and supressors will obviously require more $$$ and paperwork. Don't think you can own a full auto PS90 b/c of the year of manufacture and existing laws, but it is an area I do not know much about.

I think 86 was the year. So if it was actually manufactured in 80 you would be ok. Just expect to pay big money.

They make a semi-auto version in 45ACP. Very cool little carbine.

The P90 didn't start production until 1993 so there are none registered in civilian hands. You'd need a dealer's license if you wanted an automatic one.

Suppressor for it is legal with a $200 tax stamp. If you want the short barreled version you'll need another $200 tax stamp.

you would likely want to set up a trust, but I do not believe it means that you can get newer auto's.

You would have to become a class 3 dealer (and manufacturer?). And it is illegal to get a class 3 license just to boost your collection. If you aren't really a business, then you would go to jail.

Even with a trust the gun would have to be registered before 1986. With a Class II SOT which is a manufacturers license you can make a machine gun by taking a semi-auto version and converting it to full auto. With a Class III Dealers license you can buy the real thing from the factory. You do need a letter from a police department or something similar to buy them saying you are buying it to demo for that department. They can keep it to demo for other departments in the future.

my thought was the trust would/could get around the $200 tax stamp for the can and the SBR.

and you're right, it wont get around the full auto.

IIRC, a trust does not get you around the tax stamps. Instead of "you" paying the extortion fee, the trust pays it on your behalf.

What a trust does, if I have my facts straight, is eliminate the fingerprinting part of the paperwork. You still have to have LEO sign off and pay your $200 stamp. Other benefits are that once you are gone, the suppressor or SBR/SBS is owned by the Trust, so the executor of the trust can use the appurtance versus having to have to pay an additional stamp and file additional papwerwork to pass it on.

Because the Trust is basically a document with an endless life span, you avoid double taxation, along with you personally not owning said item.

I believe the trust also avoids the requirement for chief LEO signature, so some people do this in a place where the CLEO feels the need to be a jerk and not sign.

After reading up on them again, you are correct.

A Trust will keep you from having to get CLEO sign off and go through the fingerprint and passport photo process. It also speeds up the entire timeline significantly, especially if you live in an area that can take 4-6 weeks for CLEO sign off.

The Feds typically take the same amount of time regardless.

I have a Trust set up for our real estate holdings and what not, so I'm debating on using it to get some suppressors. There are drawbacks, so I'm still in research mode on this one. It almost sounds like an LLC is really the way to go, even with having to pay re-licensing fees annually in most states. Generally the costs are minimal in licensing fees, but the legal protection of an LLC is significantly better than that of an A/B Trust, and you have significantly broader power with the LLC over the trust as far as who can possess and use the NFA item.

Lots of questions on my end still unanswered.

I have been looking at the P90 for a while now. The best package deal I have found is on Gunbroker.com and you can get the PS90, USG and 1000 rounds for around $3000.00

I have a PS90. You can buy the civilian version - a PS90. You can then file the correct ATF paperwork and get the gun short barreled.

You will never be able to own an actual P90 machinegun. Sorry.

PS90's may be fun guns, and if somebody gave one to me I'd take it in a heartbeat, but damned if that isn't just an ugly weapon right there.

I think they look pretty cool. The PS90 shoots 5.7 right?

For a while its out of my price range, but I might like one sometime down the road.

Yes, 5.7.

and, they are about $19-$20 a box of 50, if you buy online. The prices of this have only gone up a dollar or two amid the huge increases of other ammo. So, its not bad really.
