Interesting case. I don't know whether the facts alleged in this article are true and haven't really looked into whether this agent is likely guilty of the MN charges, but there's also a significant federal preemption question. Should be interesting to watch.

Yeah it doesn't sounds real great for Christian Castro. Ellison wants to railroad him, no doubt, in a trial.

I agree with you that Ellison wants to railroad him. I find it interesting from a legal perspective (and I don't do any criminal law, so other attorneys can chime in here). My understanding is that a federal LEO acting within the course and scope of their duties have federal immunity, even as to alleged state crimes, if they are acting reasonably in the execution of those official duties. That's going to be the big question. Apparently federal prosecutors dropped the charges, so I'm curious on what basis they did so. If the shot was objectively reasonable given the circumstances, I'd think he likely has immunity.

Now the lying or false report is another thing. To the extent that's true I don't see how that could be reasonable execution of his duties, so I'd think he could be prosecuted for that.

The extradition is another question. Can Abbott legally deny extradition even if he believes and has been advised that Castro has immunity from the MN charges? I don't know that he has that discretion. It would be up to Castro's legal team to raise the immunity defense and remove to federal court.

Abbott is doing so poorly that we are one the best states in the Union for quality of life and have net migration.... Also, the governor has very little power in Texas for what he has done he has done a good job...I haven't see any Hina signs in Meyerland/Bellaire area maybe your neighbors are just idiots.

In many cases you are correct. We put a President Trump sign out the last election and I was worried about vandalism. We live in a blue district, there are plenty of Talarico signs in our community.

Not really true. The state department took over the responsibilities of doling out billions to NGOs. Nothing has really changed.
