New Mexico authorities filed suit against Meta a few years ago for not doing enough to protect children on their apps. New Mexico investigators set up a fake profile of 13 year old girl and were inundated with friend requests and provocative messages from adults. Jury verdict just came down that Meta violated New Mexico law by not doing enough to prevent such contacts. Estimates of liability up to $2 billion.

At the same time this is going on, Meta and Google are waiting on a jury verdict in California. As far as I can tell this one is related to knowingly causing harm via intentional social media addiction and is being brought by private action. The jury has been deliberating since Friday and seem to have come to an agreement on some charges but not others. The judge admonished them today to keep deliberating.

Earlier in January, previously redacted portions of New Mexico's lawsuit were released, describing an internal company chat at Meta in 2020, during which an employee asked a colleague, "What specifically are we doing for child grooming (something I just heard about that is happening a lot on TikTok)?"

"Somewhere between zero and negligible," the colleague replied. "Child safety is an explicit non-goal this half."

Jury reached a consensus on the amount of $375 million.

Still waiting on california.

Is "enough" defined in the New Mexico statute?

Great question. The media never really does a good job of explaining the specific legal issues (although they'd likely get it wrong anyway). I haven't had a chance to actually look at the suit.

This will get overturned.

Good. These companies are knowingly destroying our children and imperiling the future of humanity and I'm not being hyperbolic at all.

The suits regarding mental health and addiction are ongoing. The California one should be decided in the next day or two and there's another massive one scheduled to kick off soon in northern California and it's against pretty much every social media company - alleging severe mental health harms.

Best I can quickly find right now about the specifics of the suit.

Quote:

New Mexico's suit, by contrast, alleges Meta and Zuckerberg violated the state's Unfair Practice Act. The four-count suit alleges that the company and Zuckerberg engaged in "unfair trade practices" by facilitating the distribution of CSAM and the trafficking of minors, and undermined the health and safety of New Mexican children.

The lawsuit argues that Meta's algorithms allegedly promote sex and exploitation content to users and that Facebook and Instagram lack "effective" age verification. The suit also alleges that the company failed to identify child sexual exploitation "networks" and to fully prevent users it had suspended for those violations from rejoining the platform using new accounts

https://www.cnbc.com/2023/12/06/facebook-content-enabled-child-sexual-abuse-new-mexico-lawsuit.html

I think the definition of "enough" is difficult here. Meta is huge and they report tens of millions of instances of exploitation to the NCMEC like they are supposed to.

One of my fears we may see out of this is a requirement for a verified ID for everyone using a platform and for ID verification for all social media. We may already be on the verge of needing this due to so many AI bots.

Vague statute would be one possibility, although predicting an overturn is difficult knowing nothing else.

Sadly, in the end, this will just be a cost of doing business unless individuals are held criminally accountable.

I actually don't know that I'd hate this IF the requirement only extended to platforms where user accounts already represent real people identified by first and last name (i.e., Facebook, LinkedIn). It could theoretically cut down on tons of fraud and fake imposter accounts.

But requiring ID for platforms like TexAgs and Reddit where users are only identified by a handle? Hard no.

Where do you live that you don't show ID to vote? I'm in my 50s and have had to show ID every single time I've voted.

There are several states that don't require ID, like California and Pennsylvania. They ask, but you can basically just check a box saying you don't have one.

You still have to be registered and without an ID sign an affidavit indicating you are the registered voter. If found to be fraudulent it's a felony.

Nuance is a crazy deal...

We've learned you can vouch for multiple people in some leftist areas. And yes it's a felony but for some weird reason it's really hard to find these prosecuted. Just a big oopsie really!!

Social media should require an ID and to be 16+

And? Register to vote online and lie with one of the hundreds of millions of available stolen social security numbers. Vote absentee and never be seen in person. Good luck prosecuting someone you've never seen and didn't use their real identity.

What is vague about it?

Is it different somehow than consumer protection statutes across the country?

The NM AG is a big trophy hunter with larger political aspirations.

He has worked as a White House Fellow during the Obama Marxism era and then in the NM US Attorney's office.

Both those jobs set him up well to run a honeypot op to catch a big fish.

Don't get me wrong, pedos and social media should die in a fire together, but this Dim ass clown is looking to make a name for himself.

Nothing more.

Eight states and Washington, D.C., allow all elections to be conducted entirely by mail: California, Colorado, Hawaii, Nevada, Oregon, Utah, Vermont and Washington state.

How do you present an ID when voting in these 8 states?

Most states use combination of human review of outer, signed, envelopes and signature matching software. People and software doesn't see the ballot when checking signatures against database.

It's similar to what banks use to detect financial fraud.

If a ballot comes back with a questionable signature most states will offer voters a "cure period" to confirm their signature. If people elect not to do so they are thrown out.

And, as you know, California would never attempt to verify the truth of the statement, so they can never find fraud. Interesting to know that cheaters do, in fact, cheat.

You didn't answer my question.

And the debate regarding signature verification security belongs on a stand alone thread.
