According to the WSJ, big tech will largely get around the new H1B rules and the $100K fee.

Of course, education and government/non-profit H1Bs are not effected by the rules (or counted in the 85K H1B yearly cap).

Besides just placing foreign workers offshore... one common program used by big tech companies is the Optional Practical Training program, or OPT, which gives foreign graduates at U.S. universities temporary employment after graduation, typically for a year. Those with STEM degrees in science, technology, engineering or math can get another two years of employment before transferring to the H-1B program. Those employees won't have to pay the H-1B visa fee, making it easier for companies to seamlessly use the program.

Nothing like giving preference to foreign students, and by now many know that many of these "students" are a sham, taking classes in bottom tier universities so they can work here.

BTW, imo the problem is not with the CEOs, it is with the systems set up by our politicians. The republicans have absolutely failed at almost every level, including here and it appears with the SAVE act.

US CEOs are unethical crooks but most likely the large companies are within the rules (I think). The smaller bodyshoppers are likely cheating though but hard to call them a CEO.

This is fake news. OPT has been there forever but companies don't want to hire a new grad who they won't be able to convert to H-1 because it means that employee is basically theirs for a max of 3 years and as a junior level person that doesn't make sense. They want people they can have long term. As someone in the trenches on this our company has essentially cut off OPT hiring even more than H-1.

Can you share examples of big company CEOs saying this? Not contesting what you say but most still lie about AI, culture, Americans being dumb, being lazy etc.

They will do whatever it takes to keep their job safe. And that ALWAYS results in more bureaucracy and bigger budgets. It's why Government bureaucracies grow, and never get smaller.

It's why the number of people on food stamps always grows. No one in government is motivated to end the program. If they did, they wouldn't have a job.

My (former) company CEO openly said that in meetings for 2 years. If we have to remain competitive, all new jobs will be in India. There will be no "do-ers" in the US. They fired my entire US team (including H1s) and moved all jobs to India.
It's why I quit.
Company was acquired last month. The new CEO, said the same thing. No jobs were safe. The India offices is where he expects the most growth.

Well, your former company CEO is a crook and a charlatan. His company deserved to go out of business if he cannot figure out the business model which includes cost.

Nothing is for free.

If I was to make the rules, I would make these companies to pay a huge tax for offshoring. They can offshore all the jobs to India for all I care BUT... pay the F up! Of course they have the option to move to India and work from Bangalore if they so love India that much. No issues with that.

You cannot take the US resources and give wealth to India.

But CEOs figure that they can get around it by bribing the politicians.

In summary, your ex company deserves to go bankrupt because they suck at designing a proper workable business model.

OPT isn't really the problem. It's a true temporary status for a new grad to give them time to get a visa since they can't get an H-1 directly out of school or virtually any other visa. So you would force every foreign grad to leave the US upon graduation almost immediately without it. Now I know that may sound good to you but it's not practical.

The key is the H-1 reforms. If companies are not able to get H-1s or feel a serious penalty for using them then they won't hire OPTs anyway. You don't hire a new grad that you know has to leave in short order realistically. Much better to hire a Citizen if you are getting a junior person in that scenario. Companies already weren't hiring anyone with less than a year left on their OPT if they didn't have an H-1 secured because they would just lose them.

Trump is going right at the source of the real issue and has some smart people advising him. He isn't getting rid of visas but he is making it so that it definitely isn't a cost saving measure for a company to hire visas and is giving US Citizens a major advantage over anyone on OPT or H-1. So that will result in only the truly best foreign workers getting visas and far fewer of them while companies are incentivized to hire and train US Citizens. That's the goal unless you fall into the "We need to get rid of every foreigner" mentality which is impractical and counterproductive.

This Wall Street Journal article is very misleading as it gets people fired up about the wrong thing, the fact it is coming from the WSJ which is generally very pro immigration is also a tell. They want people to be mad at Trump because he is actually solving the problem. Don't let yourself be a tool of the globalists, that's what they are doing with this. Either that or the writer is a complete idiot.
