Just blocked Trumps EO eliminating birth right citizenship.

To the SC we go.

And the Supreme Court will punt on the case because the right answer is for Congress to pass a law / Amendment.

All we'll get out of this exercise is a Supreme Court ruling that Executive Orders have gotten out of hand.

Actually, we've already gotten a ruling that national injunctions are not allowed.

Hopefully, the SCOTUS rules that the several courts that have granted class status get their hand slapped because they rushed through. the process instead of following the actual rules to certify the class - which should take a LOT longer than these courts have taken.

I'm actually glad Trump is pushing boundaries and these leftist judges are challenging everything. I think it is intentional by Trump that this is happening. It is an opportunity to set the ship right and get the three branches operating as they should be. It may actually result in limits on the executive AND the judiciary and place proper burden on the legislative to take bake the role they should be instead of letting the other branches run rough shod. Trump won't be there forever, but some of these challenges will have far reaching implications beyond his administration which I think will be a net positive for America.
The best way to keep evil men from wielding great power is to not create great power in the first place.

Still not sure with the SCOTUS ruling against these nationwide injunctions, how this keeps happening.

On the ninth circuit case, This is really the first one since the SCOTUS Casa ruling that potentially goes against their ruling.

This affirms an injunction from the spring that covers all states, even though only some states are parties. Should have just applied it to the states actually in the case to fall in line with Casa decision.

The court here said universal injunction was needed because a person could be born in another state not a party then move to their state. I disagree with that reasoning, but SCOTUS did acknowledge that the issue of states seeking relief was a more complex issue than individuals, so needed that issue fleshed out.

(Have not read the new district court order referenced in the story)

Leo Sorokin, the MA judge (not the 9th circus) is a Columbia JD Obama judge. That's…pretty much all you need to know about him.

He also is the one who came up with his edict that deporting a guy back to Lebanon meant 48 hours notice was required. He was confirmed 91-0 in 2014, proving yet again that the GOP block in the senate has long been utterly useless.

It is infuriating. The republicans confirmed any liberal dumbass judge without a fight, but cause problems when Trump tries to get judges confirmed. Utterly useless is right.

Sorokin obviously injecting his own spiritual beliefs on open borders into this birthright citizenship matter.

It's hard to understand how anyone could be in favor of a visitor (legal or illegal) coming to our country and having a baby and that in itself is the sole reasoning behind that baby being 'born an American'.

The contrarian view (just to play devil's advocate here) is that the founders (and later 14th amendment) didn't want an underclass of long-term people/residents without citizenship in the republic, but a more inclusive body politic not limited by race/parentage etc. The experience in/from the 'old world' as to a lack of property/voting/representation rights plays into this.

But, in historically rooted analyses, that many Indians were not citizens until an oath taken etc. betrays that this interpretation of the 14th is, in reality incorrect.

The 14th Amendment (written in 1868) was not written with the forethought of the modern day illegal immigration crisis that we have in America. Just because Maria from Chihuahua makes her way across the border to drop a kid in an American hospital should not initiate a 'birthright event' - ever.

Illegal immigrants should never receive American citizenship - including their babies.

Legal immigration should be welcomed and awarded.

And as far as the Indians are concerned - face it, they got screwed by our European ancestors who just came in and stole the land - but I digress.

Why are Americans held to a different standard than the rest of the world? The world was settled by conquest.

Well, leaving aside the Indian stuff I agree largely with your broader point. And the long-running "Chinese birth tourism" industry includes many convictions now over the past 10+ years but I suspect it is still just a drop in the bucket, and exactly why we need to crack down on the very doctrines underlying this case.

To some degree, the "poor Mexican migrants" are a much smaller threat vs. Chinese/Arab and other instances of enemies taking advantage of our lax/negligent system.
