I wonder how such an event would be handled in, say, Austin.

The DA will be protesting along with the other insurrectionist.

You can in Oklahoma too! That's why protests don't get too crazy here.

Drivers should not be held responsible for any harm caused to those disrupting traffic, as long as they are doing the speed limit or less, using turn indicators for lane changes, etc.

Does one have to own the vehicle, or can they be in a rented Ford Super Duty F-10,000?

Oklahoma was the first to explicitly pass a law that clarifies you can run over protectors blocking roadways

Texas needs to catch up

I think the keys are:

1) don't do anything with your car that will look like altering your oath to intentionally run them over. So drive straight l, don't swerve into them. It will all be on video from multiple angles.

2) you might want to wait until they make some contact with your car, like banging on the hood or windows. Any decent lawyer can play up the noise factor and urgency created as reasonable belief of danger/harm to a jury or grand jury.

3) call the cops as soon as you're clear - tell them "I was just attacked at a riot, I have driven away but please send help." Then when the cops arrive, situation secure, shut the heck up and get your lawyer to do all the talking.

I'd feel pretty confident, legally, plowing straight through the middle of these crowds at 30-50 MPH under those constraints.

I've debated the desire to install a switch in my truck to disable the feature where airbags deploy and engine is cut off upon contact. Most people don't realize that ramming your way out of something will often leave you stranded right in the middle of it. However, a prosecutor is going to use this as evidence you actively planned to use your vehicle as an offensive weapon.

I volunteer to drive something like this. No guilty conscience wahtsoever for ridding our nation of the marxist cancer. In fact I'd double back to lick the tears off their face.

At 30-50? I think you're gonna wind up in hot water. These laws seem intended to let you escape, not just mow down people in the street.

There are a lot of reasons why I would NOT want to live in Oklahoma or Louisiana, but they certainly also have their redeeming qualities as well. I bet few protestors try blocking roads in those states.

If I believe the standard of "reasonable fear for my life" has been met, especially with "escaping an active riot that has targeted me for violence", I would feel pretty confident in front of a jury explaining why I wasn't going to drive below a speed most people can accurately shoot at.

In the end, it always comes down to what you feel confident explaining in front of a jury of your peers. That's also why jurisdiction matters a lot.

I would argue it doesn't come down to what you feel confident explaining in front of jury, because while you are making a logical argument, the average person on the jury will be taking emotion into it, which will completely ignore any logic.

take the average person walking down the street and recognize 50% of the population is dumber than that person, and some of those people will be on your jury...

Thankfully you need 2 rational ones on the jury to avoid a conviction.

In Oklahoma, and most of Texas, I think you could still count on two
