The current president picked a supreme court justice explicitly because she is a black woman who willingly violates her oath to uphold the Constitution. Think about that for a minute. That's not a nothingburger appearance of impropriety as suggested by the OP between Trump and Alito.

Prosecutors can talk to the president. He is their boss.

Trump should not be talking to a Justice when he has matters pending. He also should not have asked about his qualifications to serve. Both conversations are unethical.

Special Counsels are different than just a run of the mill US Attorney. Granted, POTUS does have authority to fire even Special Counsels, as we saw when Nixon fired Archibald Cox. After that, the Independent Counsel statute forbid that but that statute was sunsetted. However the tradition of independent/special counsels since then is that POTUS does not exercise control over them out of an appearance of impropriety.

What is off of the rails under Biden was the use of state and local prosecutors to attack political enemies, i.e. Trump. Sending senior members of the DOJ to not only assist, but to be in the courtrooms with an active role. POTUS is not within those state officers' chain of command.

Convos with Thomas can take place in a lower profile setting. Thomas and Ginny go to Florida often to see their son who lives near Daytona. (Not sure where but Steve Gosney is good friends with the son.)

More about Trump having a pending petition before SCOTUS at the moment regarding staying Merchan's planned sentencing tomorrow. Granted, that petition is directed to Sotomayor as the AJ having supervisory authotrity over the Second Circuit but court watchers expect her to bring in the rest of the Court.

Same as an ex parte communication. That is the issue here, at least for me.
