States can call the NG to perform law enforcement duties, but the federal government cannot unless authorized by Congress. Additonally, the guard troops still remain under the command of the state governor from the state they are deployed from.

Also - nothing gives the president power to deploy national guard troops to violate existing federal law, which is what this would be (assuming it is a case of federally called national guard troops acting against the State of Texas law enforcement and existing BP officers).

Even the Enforcement Acs clause of the statute does not give authority to the President to use troops in violation of the Constitution or federal legislation; it only provides an outlet for the President to call up military forces when state authorities were either unable or unwilling to suppress violence that was in opposition to the citizens' constitutional rights.

The Insurrection Act would also not give the President the authority to send troops to act in a manner that would violate federal and state laws. The language is very specific on what can and cannot be used as justification for a President to invoke the act and call up troops - and aiding and abetting illegal alien entry into the US in violation of federal and state laws is not among the language that would provide authorization. In fact, that is 100% against the language in the act.

There have been many National Guard Troops mobilized, from many states, serving on the border mission for years (at least 10 that I know of). They do no law enforcement and are only there to support CBP with logistics and admin. That's all this is.
