The most likely explanation of this incident is that she accidentally knocked him down while they were both completely sloshed and the DA overcharged (though I don't know the specifics of the statute) her with murder. The defense has come up with a number of theories they believe the cops should have investigated and used Turtleboy as a megaphone to win public support. Turtleboy isn't a completely innocent actor in all of this and has certainly blurred the lines between reporter and witness intimidation. I haven't followed the latest twists and turns but my understanding is the initial charges against him were when his "interviewing" of witness was more harassing the witness to change his/her testimony.
