A California moving company that uses student athletes as movers is being sued for violating age-discrimination laws.

Meathead Movers, a company that prides itself on using clean-cut youthful workers, is being pursued by the Equal Employment Opportunity Commission (EEOC).

The Fresno based business is said to have failed to recruit and hire workers over 40 into positions within the company.

Employment lawyers and trade groups have said the case will shine a light on how the agency plan to approach antidiscrimination laws, after President Biden appointed commissioners to tackle the problem.

Many of the allegations from the EEOC say that Meathead Movers focus marketing and hiring that might discourage older workers from applying.

Quote:

Workers are frequently pictured with biceps, and are seen jogging from a truck to a house when not carrying any furniture.

According to the EEOC, current employees are asked to scour local gyms, colleges and places where they would frequent to pick up new employees.

The agency had started an investigation into the company in 2017 on its own back, and not from a complaint.

According to the Wall Street Journal, the agency and Meathead Movers had attempted to negotiate a settlement in their case.

The outlet reported that the EEOC had wanted around $15 million from the company, before dropping this to $5 million. Meathead Movers offered to settle for $750,000.

Speaking to the WSJ, company owner Aaron Steed said: 'We are 100% open to hiring anyone at any age if they can do the job.

A lot of the Agencies need to be eliminated.

Quote:

Steed added: 'We had no idea we were doing anything wrong by being a moving company that hires a lot of student athletes.

'We want to change and evolve, but we can't agree to go out of business doing it.'

Collin Flynn, founder of Iowa-based UniMovers, told the WSJ that students make great employees with schedules that fit the industry.

He also added that due to the job being physically demanding, having physically fit young people works best.
How in TF is this not government overreach? So the government can sue a small business just because?

The federal government is the greatest threat to peace and prosperity that exists anywhere in the world today. Everything it does is designed to harm productivity in some way. It's not as simple as democrats and republicans except to the extent that all dems and most republicans support an all powerful federal government.
The federal government was never meant to be this powerful.

Terrible.

40 year olds typically don't want to lift heavy objects during peak moving season which is the summer.

Also note that there were no complaints. The agency is simply looking around for companies to harass.

The agencies are out of control. They are chock full of Marxist liberals.

Moving furniture and other hard physical labor is a young persons game. Especially if you are expected to do that hard labor all day at a rigorous pace. That is just a fact of life.

Recently hired 3 day laborers to move and spread dirt. One was late 20's - early 30's, one was late 30's - early 40's and one was probably mid 50's. It was obvious the youngest worker was in the best condition and was able to maintain a good pace all day. The middle age guy did well but was slowing down as the day went on. The older guy started to slow down by mid day and just could not do the work by the afternoon. I felt sorry for him and we swapped things around. The younger guys were doing all the shoveling and wheel barrowing the dirt and the older guy was given a hoe and rake and did all the spreading.

The older guy still probably would have out worked me. But, time was catching up to him.

Should be able to hire, or not hire, anyone or any group you choose. For those who feel you aren't being fair, they can form their own business, hire those you won't hire, and compete with you.

Following the shakedown formula made quite profitable by the likes of Jesse Jackson and Al Sharpton. EPA has been the worst offender in my view. Followed closely by OSHA. EEOC is vying for the title here, however.

BFOQ Bona Fide Occupational Requirement. Exception to EEOC.

And in the meantime, the most discriminated against cohort in the American workforce is the over 40 white male. I'm an employment lawyer - 56 years of age - was fired by the new boss last week. Why? I can only guess. She's a POC and a POS.

Oh man, sorry to hear that! I did consulting (not in house) in employment law in the 90s. Crap has changed a lot in that field since then. HR departments are out of control in my opinion.

You should reapply then sue when they won't hire you. Age discrimination for being an old fart...like me.

So does the EEOC sue their strip clubs, Hooters, Twin Peaks and Tilted Kilt for not hiring old, fat and ugly people of both sexes? If not they have no case.

Very true. On more than one occasion we would personally know of the perfect candidate with the technical experience that we needed and we could not get them hired. Other times they would send us people to interview that had no idea what we were doing or needed. HR did not want to hear from the engineers on what kinds of background and experience that we actually needed for positions. Even getting them on the phone was difficult.

If I remember correctly back in the 90's the EEOC went after Hooters for only hiring young and pretty girls and putting them in the Hooters Uniform. Hooters struck back with an advertising campaign with a over weight 40ish guy with a mustache wearing a Hooters Uniform. Asked the public which they wanted. The EEOC apparently quietly dropped the case.

So a new job requirement will be the ability to physically keep up with a mid 20s CrossFitter?

Or implement a Physical Agility Test like your full time FDs and PDs?

Also, screw this gov overreach!

I wrote an employment manual with some humor so people who had to read it, would, gee I don't know, ACTUALLY read it. Such as exit interviews and how not to "leave a bad tatste in thei mouths" My words because there is a way to conduct an exit interview to document at the time, EEOC requirements.

What I wrote in that manual for upper levev management would get me sued now, because I used life lessons+law+not legal writing for IANAL types.

Governments all eventually turn into corrupt organized crime families that exploit the people and refuse to give up power. Our founders understood this which is why they wanted an armed citizenry that was as free of dependency on government as possible, ie citizens that are very hard to exploit. Naturally leftists want none of this because the big guy needs his 10%
