Sotomayor and KBJ trying to push the theory that race is culture and simply being black means discrimination occurred, so its okay to take race into consideration.

So what if minority enrollment does go down post affirmative action policies? That kind of proves it was de facto discrimination all along, doesn't it? Not based on merit.

Seems like Sotomayor? was arguing for government sanctioned racism because America's "leadership" "looking like America" is an inherent good. America is about people taking advantage of opportunity and working hard. These racist admissions policies by universities are unbelievably anti-American at their core.

Why is there even a box to check in the first place? Take the box off. If in an essay they care to choose to assert a racial hardhip or complaint, that is a different question.

Kagan: evidence suggests that gender neutral applications results in many more women. if university decides thats not good to have so many more educated women compared to men, can school tip the scales to more men being applied?

lawyer: its intermediate scrutiny for gender policy and strict scrutiny for racial policy, so you can't make that analogy.

Gorsuch: what about religion? Harvard tried to reduce the number of jewish students.

She was supposed to be for the Harvard case since she is on the Board of Governors who approved their process.

Affirmative action should finally get ended with this case, but what's to stop the liberal colleges from still doing this anyway and accepting blacks because they're black.

I recall they were only taking the cases if they could hear both together but they split it apart when she joined the court.

Lawsuits maybe. Frankly the Oberlin Colleges can do whatever they want in my opinion. I'm far more aggrieved when state schools like UT-Austin or University of Washington discriminate against Asians or whites.
