WASHINGTON, D.C. Over the weekend, America First Legal, through its Center for Legal Equality, filed a landmark class-action lawsuit against Texas A&M University over its racially discriminatory faculty-hiring programs. AFL seeks declaratory and injunctive, as well as the appointment of a court monitor to oversee the A&M's faculty hiring and its "diversity office" to ensure that the university does not violate the nation's civil-rights laws.

Quote:

Texas A&M Unlawfully Discriminates In Its Faculty Hiring Based on Race.
Texas A&M has engaged in a discriminatory hiring practice, choosing which candidates to hire based on their race or sex.
In June, Texas A&M announced in an email to all of its deans that, based on its designation as a Hispanic Serving Institution by the United States Department of Education, it had been "charged with expanding the capacity of low-income, first-generation Hispanic students, and other underserved students and their communities." Texas A&M stated that "increasing opportunities for underserved students to interact and engage with faculty that share their ethnic, life, and cultural experiences are essential to achieving this goal. The presence of faculty of color is also integral to the University's mission to provide the highest quality of undergraduate and graduate education and develop new understandings through research and creativity."

Anybody familiar with this one?

You're not supposed to openly admit you discriminate against white candidates. You just do it and tell yourself it's okay because "muh progress"

They had racial faculty quotas in Engineering going back to at least 2003 as determined by FOIA requests. I published it to TexAgs but no one seemed to care then. Hopefully this suit gets better traction.

Well that kind of defeats the whole purpose doesn't it? it's done in the first place to virtue signal...which by definition requires shouting it to the public...

That's why you have to be more subtle with programs like Top 10%.

Affirmative action never works long term and it always has a negative effect. The proper route has always been to make things equal and realize it will take time for some groups to catch up but eventually they will. If you look at Blacks in this country they were progressing rapidly up until the '60s when The Great Society and Affirmative Action programs destroyed what was a great opportunity if they had simply made the rules equal and race not to be considered at all.

I hope A&M gets hammered in this lawsuit.

The new modern rules are if you are white you can be openly discriminated against.

It's become perfectly acceptable and even said to be deserved by some.

It still blows me away when you read documents like this how racist and sexists these diversity goals really are. I know I shouldn't be by this point, but I am.

You don't find anything on there about qualifications or merit. All that matters is their sex or the color of their skin. The very definition of sexism and racism.

True. A&M is no different than corporate america in this respect in that there are open stated goals of executives to hire/promote "qualified" minorities and women.

Bravo!!! I support the lawsuit. Race-based hiring has no business in American universities.

Strange criteria you have there to determine the merits of the lawsuit itself &/or the barristers working on same. I guess you prefer your pigs with lipstick.

It goes back to at least 1985 in my case where I was told by the TAMU Engineering Co-op director that he would not submit me for the best Co-op jobs because I was a white male and not a minority or woman. The lower paying and less high-tech jobs I was allowed to have changed the course of my career and life.

I'm confused, are they being sued for focusing too much on minorities or for not hiring enough minorities?

Nothing will come of this either way, but I'm not surprised someone is trying to target A&M.

Oh I see, being sued for discrimination against whites and Asians.

If this helps to squash the leftist bs influence on A&M, then I'm all for it. But if this lacks merit, then it just looks like a tsip prof lashing out at A&M.

This is gaining steam as a black eye for A&M, it's starting to circulate in the conservative media:

This has legs.

Quote:

The lawsuit was filed in the Houston Division of the Southern District of Texas. As a result, any appeal of the case will go to the United States Court of Appeals for the Fifth Circuit, which, lately, has not been particularly enamored of the woke practices of Texas state universities. Fifth Circuit Judge James Ho has already raised serious questions regarding the legality of DEI initiatives. In short, it looks like a very well-planned test case. (Professor Lowery is being represented by counsel from the America First Legal Foundation, which has an excellent track record in these kinds of test cases.)
How does the case shape up legally? Asked for comment, University of California, Berkeley law professor John Yoo says:
Quote:

This seems like a strong case. The Supreme Court's diversity rationale for the use of race in university admissions for students is a limited exception to the general rule that the Constitution prohibits government from using skin color in its decisions and policies. Here, Texas A&M is flatly using race in considering the hiring and compensation of faculty. It is flatly unconstitutional and the university should lose in court.
Cornell University law professor and Legal Insurrection Foundation president William Jacobson agrees:
Quote:

This is an important case that puts the legal test to what we all know happens throughout higher education, racial and sex discrimination in the name of Diversity, Equity, and Inclusion. Too many schools incorporate the discriminatory philosophy of "antiracism" huckster Ibram Kendi, that current discrimination is the remedy for past discrimination. Such a philosophy is illegal when put into hiring and promotion practices, and thanks to Prof. Lowery for having the courage to say so and to challenge this immoral regime in court.
University of San Diego law professor Gail Heriot, who is also a commissioner on the United States Commission on Civil Rights, observes:
Quote:

For a long time, faculty members and aspiring faculty members who have been discriminated against have been reluctant to suemainly out of fear that they will be ostracized. As a result, college and universities have gotten bolder and bolder in the ways they flout the law. But the tide appears to be turning. There will likely be more lawsuits of this type in the near future."

I do wonder if standing will be an issue. I would think the Plaintiff would need to have applied/interviewed and/or received less compensation from A&M to bring suit.
