Question: The replacement for retiring Justice Breyer won't shift the ideological balance of the court. But if Biden successfully installs a Black woman to the seat, what will be the significance of that appointment?


Meg Penrose, a professor at the Texas A&M University School of Law response:

"A court that more fully reflects America one with race, gender and religious diversity will hopefully produce legal opinions that more fully reflect the diverse opinions in our country.

Nominating a Black woman will have great significance for both race and gender. This nominee will be only the fourth person of color to sit on our Supreme Court. This nominee will be the sixth woman to sit on our Supreme Court. And, while there have been two Black justices sit on the court, this will be the first Black female.

There is value in having children see that our court looks like the society they live in. Regardless of race, gender or religion, a child should be able to look at our justices and see themselves sitting on the court someday. Judge Jackson wrote in her high school yearbook that she wanted 'to go to law school and eventually have a judicial appointment.'

Women currently make up roughly 51 percent of the U.S. population. We have never had more than three women on the Supreme Court at one time. This shift giving us four women moves us closer to reflecting the actual population in our country. In addition, women comprise over 54 percent of all law students. Ensuring that the court is populated with qualified women is a natural consequence of women continuing to enter the legal profession."

Using skin color as a determinant for any position is never right.

There are justifications for choosing a candidate based on biological sex, but not for the Supreme Court. That position should be filled by the most qualified candidate, based on a rigorous set of criteria that are generally agreed on by the public/elected officials.

In other words, the constitution will be ignored even more.

Black females vote for Democrats at at a 95%+ rate.

And Democrats do not believe in the constitution.

Ergo, we will in all likelihood see further degradation of the rule of law.

The mastodon in the room is this person is not being nominated because they are the best candidate. It is about feelings and checking boxes. Dementia Joe did not hide the fact that this selection was solely based on race and gender.

If he had stated he is going to select the best candidate and then presented his selection then, at least at that point, a debate could occur on why this is the best candidate.

No Hispanic men.

Zero amputees.

No former military.

And guess what? I DON'T CARE. I want my Supreme Court justices to be people of high moral character who know the laws better than the people who wrote them, and who do not desire to make great changes to the Constitution or see the judicial bench as a place for political activism.

The biggest changes to our society from a legal standpoint over the past two decades have come via the decisions of five or six people who used their position of power to affect all Americans in ways the founders never intended. Rather than seeing their role as that of interpretation and enforcement, they seized opportunities to fundamentally shift major dynamics of our culture by making/changing law.

We need a hard reset for the SCOTUS, but not the kind this "woman" of color will encourage.

At what point do we stop saying "this is only the x female and y person of color to hold z position"? I'm so damn tired of racist liberals. We've had a black president elected twice. We've had black and female SC justices, state governors, senators, etc etc. Enough of the division, liberals.

But the difference is that even Breyer had a limit with trampling the Constitution. KBJ on the other hand is part of the new Sotomayor Dem template for judges: a minority female picked to be a rubber stamp for the Dem agenda that doesn't care how unconstitutional it is.

The Constitution could be as crystal clear on an issue as possible and, like Sotomayor, KBJ will still vote against it if the Dem agenda requires it

I'd bet my life that 90% of blacks have no idea who sits on the court. So I don't think it has much value at all.

They saw Obama as president, and now a black cartoon character as VP, and that hasn't changed anything. Well, check that: crime has gotten worse as has race relations.

No kidding. The court is nothing more than a who's who of the Ivy League schools, primarily from the NE that do not represent the rest of the country well, and, frankly, it becomes an echo chamber even with the left and right wings of the court.

And quite simply put - the idea that any group needs to "look" like society is pure garbage.

Because if we really want it to look like society....then we need to have a wide range of people, economic status, education status and life history status on said court. And that isn't what anybody really wants from a supreme court.

I want the 9 most qualified justices who adhere to the Constitution and how it was written, not how they want it to be written. I don't care if they are white, yellow, brown, black, blue, green, XX, XY, identify as a potato or whatever other stupid socially driven metric there is - so long as they rule based on the CONSTITUTION consistently, that is literally the only thing that matters.

Sadly, the voting block she is joining doesn't apply any IQ anyway, so it wouldn't matter. They vote strictly and immediately along party lines, every time. Beyer did, and so will his replacement.

If anything that's been a big problem the past 30 years. Republican nominated justices keep applying their own judgement, even disagreeing among themselves quite regularly and NOT along party lines. Meanwhile the Democrat nominated justices simply vote in block, with no regard for what the laws actually say.
