At 5 pm this evening, an emergency meeting of the Commissioner's Court was held.

Quorum was not met as 2 of members failed to be present.

Therefore, the injunction that was filed at 9 am has been lifted.

The consequences are the fines which will be administered tomorrow evening.

So, SEE YOU WHEN IT BURNS!

I don't mean to be a damp blanket but you are really making a mistake going ahead with burn. It is setting a horrible example for the Aggies. "If we don't get our way, we'll just go ahead and break the law and pay the fine." That really hurts the integrity of the Aggies. I'm really sorry you have decided to do this. God forbid that an ember get blown off of the stack and start a fire under the dry conditions we're under. You will be in more trouble than just a fine. You may be costing someone their home or their life. Please rethink it.

The burn ban wasn't put into effect just for the heck of it. There was a reason and conditions haven't improved it.

ldyaggie, the place where bonfire is held is not anywhere near able to cause any damage to homes, so don't worry about that, BONFIRE MUST BURN. Its just the only way.

There will be Fire Department and EMS services ON SITE, not because of the burn ban, but because they bring them out every year.

Also, are you familiar with the area around Hot Rod Hill? Embers have a much better chance of hurting cars than it does homes in the area.

SB has a tough decision to make, but ultimately all of the efforts of their constituency and donors far usurps a $500 fine.

If you want to come in with the holier-than-thou "you're breaking the law and making a mistake," you're entitled to that stance. However, this "someone might die from the embers" thing is totally alarmist and not well thought out.

I am not speaking out of ignorance. I know what can happen. Am I familiar with the area? I would say that I am since I can see Bonfire from my house. I just pray that nothing happens that you will regret.

I won't regret anything, I'm not involved in the organization.

I'm sure SB will be happy to know that the neighbors are preemptively ready to come after them though.

If a controlled fire escapes the property on which it originates and damages the property belonging to another (think pasture, fenceposts, etc.) then the appropriatge criminal offense that is frequently used is "Reckless Damage", another Class C misdemeanor. Of course, being charged and convicted with such an offense would pretty much take away any defense in a civil suit for monetary damages.

I assume the revenue from the tickets purchased to go directly to Bonfire? If so, I will go buy multiple tickets - for revenue and for you to do like the universities do in claiming more in attendance!!!

Not that there's any substantiality to this... but... since the Texas Forest Service is operated in conjunction with A&M, maybe when we were on campus and there were burn bans, the TFS lended a hand...

i hope she didnt die from an ember... I know that there were several rampant brush fires in the area shortly after 9pm saturday night.

The University is state property, therefore not subject to the county's burn bans.

(at least that is what i have been told)

No, my house didn't burn down. It was only by the grace of God that there was no wind to blow the sparks any farther than they went and also that the fire didn't burn completely. I drove past the sight on Saturday and saw a lot of dry grass around the race track. If any embers had been blown away from the fire for any distance (and embers can be blown quite a ways, I know from experience) trouble could have happened.

I only hope that y'all will have enough sense to wait until the ban is lifted and conditions are better before relighting it to get rid of the stack.

Just remember, if you break the law twice, it may not be as lenient as a $500 fine.

You may be assured that nobody will now be in a rush to light the bonfire.

Friday's injunction put the students in an untenable position. They has been assured of a "ceremonial" exemption for the 14 weeks--since they first met with Judge Sims. Then, at the eleventh hour, he said he "read farther down into the document" and found out that counties could impose more stringent burn bans.

(I know that because I questioned him at length Friday evening--after his recalcitrant fellow commissioners failed to show to face the public wrath over their decision.)

In other words, after the organization had contracted in good faith for busses, security, ticket takers and a myriad of other services -- assuring financial disaster if they could not collect the admissions and parking fees -- they were hit by an unexpected injunction.

The Bryan fire department was on the scene. They were equipped with water cannon that could have been deployed from elevated cranes. I doubt there would have been significant grass fire damage even if sparks had flown.

Furthermore, consulting the weather forecasts would have alleviated fear of the wind-blown chips you mentioned. The entire south and lower Midwest were under the influence of a dormant high-pressure system. Weather forecasts called for light to negligible winds.

The same meteorological conditions that continued the drought also cancelled the winds that customarily blow at this time of the year. You may credit the grace of God, if you wish, but a more scientific approach would have alleviated many of your fears.

I say this because your entire demeanor during this ordeal has been one of uninformed panic. The distance from the burn site to neighboring houses is much greater than from the nearest dwelling when the university used to light Bonfire on campus. Yet, as my wife stated in a letter submitted to the Eagle, county officials never tried to tame the 800-pound gorilla when Bonfire was ignited in spite of similar drought conditions at times during its 90-year history.

But when undergraduate students presented a weaker target, the anti-Bonfire forces played their hand through county government.

What will your strategy be next year, even if the ground is soaked by the customary moisture found this time of year? I can't believe your opposition was fueled solely by fear of a grass fire.

i feel ya. i aplogize... just alot of negtivity from about 2 people on here that dont see the relevance of bringing our community together. I know everyone is entitled to thier opinions and others may not agree, diffrent strokes for diffrent folks.

just want to extend my thanks to all involved to keep the tradition alive. the loudest whoop to everyone that helped make it burn this year.
