So I'm subdivision has a rule that if you live on a green belt you must have a wrought iron fence. All the houses on the greenbelt have wrought iron fences and basically no privacy in their backyards. Someone who lives on a green belt just put up a 6-foot privacy fence inside of the property line wrought iron fence. The wrought iron fence is still there. They're following the rules... which don't say anything about not having a wood fence. They just indicate that you have to have a wrought iron fence. People in the subdivision are losing their minds.

I chose to live in a subdivision that has an HOA and I like living here for the sake of property values. However, I think that this is hysterical. I don't live near these people and I can't see their fence. I'm waiting to see whether the homeowner or HOA wins this one.

Most have a straightforward rule that any changes to the exterior must be approved by the HOA. Probably will not end well for the fence builder guy

Ambiguity in rules or law ALWAYS favors the defendant. They will win if there is a civil action or even arbitration.

Not if, as previously pointed out, they failed to submit their design to the design committee for approval prior to installing it.

IF that is required. It's all going to depend on if they followed the letter of the rules.

The design review guidelines for my Hoa clearly state 'fences may not be constructed without committee approval.' , just like any additions or modifications to your exterior.

Then goes on to say 'double fence not permitted.'

Even has a third section 'fences for screening located within lot line - approval required.'

Your neighbor is a dumbass if he thinks there isn't similar verbiage in your articles and that he's going to get away with it.

He'll be taking it down in no time.

OR, your Hoa document creator is a dumbass for having something like covered. So many of these documents are recycled over and over and copied from other management companies. I know ours are.

The landscaping guidelines included in our deed restrictions would would prevent him from doing that.

There's actually a list of plants that we are not allowed to use in our subdivision.

Oh, yeah. Neighbor down the street parks and old red pickup truck on the street every day and has everyone on the street pissed off. HOA actually managed to force him to remove the "project" Triumph to storage.

I mean you can own a junk car and park it on the street. But leave it there in a manner that might suggest that it doesn't run or that's where you're storing it and you're going to get in trouble. It has to move frequently.

What a strange world we live in. We will have legal action on a privacy fence that affects nobody; but we can't even get our countries borders secure. Some people have way too much time to worry about the neighbors they have now. Just wait until your new neighbors arrive and start putting out the flamingos in the yard. There is going to be some upset folks in these neighborhoods when the plastic flamingos take over their greenbelts.

I always hated that they seemed selective about enforcement. You see numerous other people with similar violations for months, but you get a letter for it. We also once had on HOA send a letter to us regarding something that they couldn't possibly have seen without trespassing.

Yeah, this. I don't have one, on purpose, but when I was house hunting my realtor showed me some houses that had "weak" HOA's and there was always That One House where lawn maintenance had stopped, and the rot spreads outward from there. The point of these things is to keep property values up, and in the real world in which we live, a lot of people don't want the "natural" front lawn or the project car sitting on blocks for months or years,

That said, the kind of people that gravitate to HOA "leadership" or whatever appear to be almost exactly the people that you don't want doing that. Hall monitors!

None of this sounds as bad as having an HOA honestly.

See there's a simple solution. Don't buy a house with an HOA or with an active HOA. And if HOAs are important to you, buy a house in a subdivision with an active HOA.

Oh, well, I'd he's REALLY smart then he should judge and belittle folksfor making informed decisions with which he disagrees. Just to show that he's better than other folks.
