No. Congress has the authority to tax. What his ruling stated was that the mandate did not force anyone to buy insurance but rather taxed those who chose not to. It still opens a can of worms, but not as big of a can had he ruled it constitutional via the commerce clause.

If I worked anywhere near the Supreme Court I'd exercise all the control I could, but I don't think I'd be able to refrain from singing the following everytime I saw him:

If I understand it correctly, labeling it a tax gives Republicans in Congress the chance to "lower" it via budget reconciliation to $0.00, essentially cutting the nuts off of the mandate.

If it happens, Roberts will be hailed a hero.

If you ever do run into him, go say hello. He's a wonderfully nice man, and will have a good conversation with you if you introduce yourself.

I recently had the pleasure of having lunch with him, and he was very down to Earth, and very conversational. He stayed behind and hung out with me and a few friends for an hour or so after lunch had ended, just chatting about stuff.

On a side note, he likes A&M and College Station, and is particularly fond of Chicken Oil Co.
