In my businesses, we do not differentiate between debit and credit cards; we process them all the same. (No PIN pad) But, I was under the impression that processing the actual card as debit vs credit made the fees different...(actually less for debit than credit was my understanding) How are they processing the debit card as a DEBIT card without a PIN entry? (Sorry if that is over-rambled and I'll review to clean up if possible)
And finally, I checked on this the other day and it remains true today - the No Cost Debit of Texas website is down.

If the merchant is stupid/stubborn enough to still be charging the fee on Aug 18, I am hoping for MASSIVE fines on both merchant and processor.
