One of my very favorite Mexican places is still doing it - today. I like them, I know eventually, they'll have to stop doing it. But what I did notice is this: Last time I went, I paid with a credit card and it showed charging then refunding the $.49 I believe. But today, I paid with a debit card and it charged me the $.49.

In my businesses, we do not differentiate between debit and credit cards; we process them all the same. (No PIN pad) But, I was under the impression that processing the actual card as debit vs credit made the fees different...(actually less for debit than credit was my understanding) How are they processing the debit card as a DEBIT card without a PIN entry? (Sorry if that is over-rambled and I'll review to clean up if possible)

And finally, I checked on this the other day and it remains true today - the No Cost Debit of Texas website is down.

A co-worker brought in Shipley's this morning and confirmed there was no charge for debit-card use.

I'd suggest that for positive reinforcement we should visit our neighborhood Shipley's over the next couple of days and each thank them and tell them the lack of the fee is the reason for the visit/return.

A debit card is processed as a debit card regardless of whether or not a PIN is entered.

I did indeed go to Shipley's this morning, confirmed they no longer charged the fee, then bought over $50 in donuts and told them I was celebrating that they once again had my business for the first time in a long while. They were appreciative.

So if you get to work this morning and there are Shipley's donuts, you're welcome.

As did I. (Well, not quite $50 worth; I don't have that many co-workers) but I did go back to a place I had almost entirely avoided during this whole thing.

I spent more this morning than I had in the entire time combined that they had the CharlieB system in place. Never sent in any receipts or anything; I simply avoided those places that did it.

As others do this, I'll revisit them as well (Well, not Buppy's; I just plain flat out hate their food, so that's been an easy avoid for me!) and probably be doing the same.

Just got back from Cici's in College Station and had a rather "animated" discussion with the manager. They are indeed still charging the $.49 debit card fee even though the DOB letter they received says that they cease charging the fees immediately. I told him I was surprised to see they were still charging it with the recent KBTX article and the DOB letter. He quickly snapped back with "there's nothing illegal with what we are doing" and "it's actually our processor who charges the fee" and "we don't get any of that money, the processor gets all that" and "our processor has told us that it is completely legal".

Thought it was interesting how heated he got when I asked why they were still charging the fee. That question must be coming up quite often. Maybe KBTX would be interested in interviewing the manager...he would make for a lively story!

I think Shipley's removed Charlie B altogether. He's a snake. There was a 0% chance this was going to be upheld yet he was selling it after the law passed.

I got a little chuckle when I saw the payment systems that Shipley's is now using; it's his arch-nemesis Heartland Payment Systems.

And the Manager of CiCi's (if he was a taller, heavyset Hispanic man, he's the franchise owner) can go eat a bag of Richards as far as I'm concerned.

I remember once when my mother, sister and myself were out and needed to get a quick bite to eat. We stopped in, and due to a bank card problem, I only had enough cash on hand for two buffets. I bought my mother and sister's meals and asked the check-out kid if he minded if I sat with my family and promised I wouldn't eat anything or take any drinks. He said it was OK.

So we sat down and within three minutes tops, Mr. Chuckles dropped by and said I had to go. My mom and sister hadn't even come back to the table yet, so there's no way I could have taken anything from them without paying, even if I would've. I said that I wasn't going to have anything and was just sitting with my family, and that I'd asked the guy at the counter and he'd said it was alright.

He said that the counter guy was wrong and that I needed to pay or leave. So, I went outside and waited in my car for my family, who after seeing this, couldn't get refunds.

Since that time, I've done everything possible to avoid that place like the heartburn it's products give.

First, CiCis is gross...the food, the atmosphere, the dirty silverware/glasses. I guess they stay in business due to small kids or broke college kids (been there, done that).
Secondly, what is going to be done to the ones who are still charging the fee (I'm looking at you LaFamilia on Barron)? I thought I remembered someone here saying the restaurant said that the company overseeing the fee was paid directly-is this money going to be refunded or given to the restaurant?

Heartland, in my opinion, is better than No Cost Debit (because they aren't advocating illegal fees), but they are still more expensive than alternatives in town.
