Whatever company that we go to pee at does our random calls/requests.

They have our list, and they call a random person once a month unless our insurance Specs change for a company.

I'm sure they are just going down a non-alphabetical list but it appears random to ISNET world.

They have some tools that would work and I think that they publish enough info about their methods to be "official" enough to satisfy whoever is imposing this requirement.

There is no indication that the first person has done anything illegal. If you're in Texas then popping positive for weed is an indication that he's broken the law.

Maybe this person thinks that weed being illegal is stupid. That's fine. Maybe this person thinks that something in your company policy is stupid so he will just disobey that, too.

I would also contend that someone who is aware that he can get fired for smoking weed but just can't help but smoke weed anyway might be addicted. Or maybe he understands the risk of smoking weed and he's cool rolling the dice, in which case getting fired won't be that big of a deal to him.

We contract with a company to do ours. All employees names are submitted to the testing company. They make the random selections.

Not sure on that end. We are a heavy industrial manufacturing facility with tons of hot steel, dozens of overhead cranes, and 15-20 pieces of mobile equipment. It's a safety thing more than anything, which makes it a violation of company policy.

Makes sense.

I'm just playing Devil's advocate here. Does a company fire someone for breaking the law on their own time? There are probably far more functional alcoholics around than "refer addicts".

This is a ridiculous question. Of course companies fire people for criminal activities on their own time. Have you ever had a job that disclosure of any criminal history wasn't part of the application? That doesn't stop once you're employed.

If they are aware of the law breaking, but many companies do not go actively looking up their employees criminal behavior. It's not a ridiculous question.
