Retirees and the UCMJ

I'm aware that retirees are subject to recall under various states of emergency and to the UCMJ when recalled, but was not aware of this.

Seems that maybe the Dept of the Navy is dealing with that delicate balance of the US military in Japan, including the guys that decide to stay after retirement. They found a "loophole" and are trying to keep the locals in Kadena and elsewhere happy.

Wonder if (or why not)the Japanese authorities prosecuted these guys?

It is rarely used. You probably have to order the retiree back to active duty and pay them so you can punish them. These guys may not have a current uniform and may not meet grooming/fitness requirements. The whole thing would be pretty awkward. In not sure offhand who the approving authority is, but it might have to be approved by the Service Secretary. As you can imagine, it is rarely in the best interests of the military service to go that route.
