Was surprised this wasn't already posted.

All law enforcement is now on an encrypted channel so we can't hear what is going on, but they know its him and he is armed with some kind of rifle. I would assume based on how many times they've heard multiple gunshots that he's some kind of semi-automatic rifle or carbine. Brazos County is still #1 on Broadcastify, but its only routine stuff now.

And I'm not being critical of them for going to the encrypted channel. I know why they go to the encrypted channel and fully support them doing so.

He's facing 25 to 99 years or life with the possibility of parole after thirty years because of his record. He was previously sentenced to probation for arson with the requirement to pay more than $24,000 in restitution and spend three months in prison, then his probation was revoked and he was sentenced to three years, then he committed aggravated assault causing serious bodily injury after he got out and was sentenced to five years and required to pay $5,000 in restitution. He also has convictions for theft (two counts), burglary of a vehicle (two counts), assault causing bodily injury, possession of marijuana, evading arrest, driving with a suspended license (two counts), and resisting arrest.

According to online jail records, Herrin has been booked into the Brazos County Detention Center nearly 20 times since 1995. His criminal history includes charges of arson, aggravated assault causing serious bodily injury, vehicle burglaries, home burglary, theft, and fleeing a police officer.

Possible charges: Two counts of aggravated assault against a public servant (or attempted capital murder, both carry the same penalty, but aggravated assault is easier to prove), felon in possession of a firearm, unauthorized use of a motor vehicle, evading arrest with a prior conviction (all felonies)

Arson, aggravated assault, assault, shooting cops, stealing a car, burglary of a habitation, vehicle burglaries, having a gun as a felon, evading arrest, resisting arrest, theft. With a record like that, he's never getting out. There was another guy in Brazos County who shot a police officer and had previously been to prison twice like this guy, and he got ninety years (eligible for parole after thirty), so we'll see how long this guy gets.

How could shooting anyone intentionally not be attempted capital murder? That conviction should be a slam dunk.

For aggravated assault, they have to prove that he shot the police officers and caused them physical pain, but for attempted capital murder, they have to prove that he intended to kill them.

The vehicle burglaries, theft and fleeing were misdemeanors, he was never indicted for burglary of a habitation after his arrest, and he went to prison for the arson and aggravated assault (he was sentenced to three and five years, respectively, and both were plea deals). All of his convictions except the arson and aggravated assault were misdemeanor convictions.

He had a fleeing and felony theft in 2018. Were those reduced to misdemeanors?

Those were both Class B misdemeanors, so he wasn't charged with felonies. The theft was under $100 with one prior theft conviction (his previous vehicle burglaries didn't count as theft convictions), and he was charged with fleeing from a police officer, which is a misdemeanor, not evading arrest, which is a felony with a prior conviction. If he was charged with evading arrest with a prior conviction, he would have been facing up to twenty years because of his two prior prison sentences.

He was facing up to twenty years for the arson conviction and he ended up getting three years, and he was facing up to 99 years for the aggravated assault conviction (up to twenty years, but the maximum penalty was increased to 99 years because of his prior prison sentence), and he got five years. Both sentences were plea deals. He's an idiot for doing what he did, especially with his record.

It doesn't say how long he served, but the minimum prison sentence he could have gotten for each of those charges was two years, so he got close to the minimum prison sentence both times. Also, believe it or not, he's eligible for probation for his new charges (even with his record) if he pleads guilty, but he's obviously not going to get it and has a much higher chance of getting a life sentence than he does of getting probation.

Actually, he served at least four years and one-and-a-half months of his five year sentence for aggravated assault (at least 82.5 percent of his sentence). He might have served more or the whole five years, but he served at least that much. I wasn't able to find out how much of the three years he served for his arson sentence.

He probably served the entire 5. Guys like that can't stay out of trouble anywhere and constantly have cases while they are locked up.

Do you know how many times he was shot? Also, Rusty Surette posted that the Mustang he was driving was stolen from a body shop on Finfeather Road, so that's another charge against him.
